Numerous charges have been filed against two Macon County men, after the Lafayette Police Department apprehended them as they were trying to leave Ace Hardware with property that belonged to the business.

A call came into the Lafayette Police Department on Thursday, May 16 that two individuals were behind Ace Hardware inside the fence attempting to steal property. “When Patrolman Derrick Gann and Sgt. Shane Reid arrived at the scene, two people in a blue van were attempting to leave the parking lot,” said LPD Detective Jason Roberts.

They were able to stop the vehicle and found 43-year-old Michael Kevin Posey behind the wheel and 36-year-old Terry Allen Bennett on the passenger’s side.

Both suspects had been drinking and the officers observed open beer cans in the vehicle.

“When the key holder arrived, he identified the property that was in their possession as being taken from the business,” said Roberts.

The two men were immediately placed under arrest and carried to the Macon County Justice Center for booking.

Michael Posey was charged with driving under the influence, driving on a suspended license, theft of property, burglary, violation of open container and financial responsibility violation. His bond is set at $11,500

Terry Bennett was charged with burglary, theft of property and public intoxication. His bond is $4,500.

Both men are to appear in General Sessions Court on Wednesday, July 10.
