NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated April 5, 2007, and the Deed of Trust of even date securing the same, recorded April 10, 2007, at Book TD420, Page 342 in Office of the Register of Deeds for Macon County, Tennessee, executed by Lisa J. Jenkins and Alma Doris Jenkins, conveying certain property therein described to A. Russell Brown as Trustee for Mortgage Electronic Registration Systems, Inc. as nominee for Metro Finance, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on August 14, 2014 on or about 12:00 P.M., at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
A certain tract or parcel of land located in the 9th Civil District of Macon County, Tennessee being described as follows:
Beginning on an iron pin Southwest corner of this area and a corner of Billie W. Doss property running with the original deed made in October 13, 1944, North 55 degrees East 874.04 feet to a beech tree, North 4 degrees West 247.5 feet to a dogwood tree, this bisecting said deed North 43.09 degrees West 657 feet to a point in the South margin of Swindle Road thence with the South margin of Swindle Road South 45 degrees West 260 feet South 67 degrees West 139.22 feet to a corner of a building lot thence leaving Swindle Road with building lot South 13.27.15 degrees East 171 feet to an iron pin in the Doss property thence with the Doss property South 13.27.15 degrees East 789.34 feet to point the beginning, according to a survey prepared by Joe E. Holland, Sr., Registered Land Surveyor Number 492, Holland Land Surveying, 606 Red Boiling Springs Road, Lafayette, Tennessee 37083.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
