NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated November 30, 2006, and the Deed of Trust of even date securing the same, recorded December 8, 2006, at Book TD412, Page 359 in Office of the Register of Deeds for Macon County, Tennessee, executed by Lloyd J. Graves, Jr. Kimberly D. Graves Lloyd J. Graves, Jr. Kimberly D. Graves Kimberly D. Graves and Lloyd J. Graves, conveying certain property therein described to Emmett James House or Bill R. McLaughlin as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Regions Bank DBA AmSouth Bank, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on September 18, 2014 on or about 12:00 P.M., at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Lying and being in the 4th Civil District of Macon County, Tennessee and beginning on a beech the North West corner in the East margin of Dark Hollow Road and a corner to Barnsfield running with said road and E. D. Cothron’s line South 16 degrees West 504 feet South 9 degrees East 300 feet, South 2 degrees East 214 feet, South 11 degrees East 353 feet to an Elm a corner to R. D. Cothron; thence with R. D. Cothron’s lines crossing the creek and up the hill South 76 degrees East 400 feet, South 81 degrees East 1650 feet to a stake a corner to Joe Nash; thence down the Hill and with Nash line North 9 degrees East 300 feet, to a point in creek; thence up the creek North 70 degrees East 330 feet to a stake the South East corner of the land; thence with Nash line North 1400 feet more or less to Hickory on top of hill a corner to Barnsfield; thence with Barnsfield line down the hill to a white walnut branch thence down the branch in a general direction South 87 degrees West 2250 feet to the beginning beech, containing 69.33 acres more or less.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
