NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated September 30, 2008, and the Deed of Trust of even date securing the same, recorded October 3, 2008, in Book No. TD448, at Page 351, in Office of the Register of Deeds for Macon County, Tennessee, executed by Mitchell Etheridge and Charlotte Etheridge, conveying certain property therein described to Arnold M. Weiss, Esq. as Trustee for Wells Fargo Bank, N.A.; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wells Fargo Bank, N.A.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wells Fargo Bank, N.A., will, on March 12, 2015  on or about 12:00 PM, at the Macon County Courthouse, Lafayette, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:

Located in the 6th Civil District of Macon County, Tennessee, and more particularly described as follows:
Beginning at a half inch rebar (new) in the West margin of Old Lake Road, being the Southwest corner of Nathan Young (246-139), also being a corner of Earl and Gracie Wiley (218-37); thence with the west margin of Old Lake Road South 56 degrees 09 minutes 11 seconds West 147.09 feet to a half inch rebar (new); thence leaving the West margin of Old Lake Road and severing the land of Earl and Gracie Wiley (218-37) North 55 degrees 01 minutes 47 seconds West 413.46 feet to a half inch rebar (new); thence North 28 degrees 29 minutes 16 seconds East 434.51 feet to a point; thence continuing to sever the land of Earl and Gracie Wiley (218-37) North 81 degrees 22 minutes 47 seconds East 311.93 feet to a half inch rebar (old), being the Northwest corner of Nathan Young (246-139); thence with the West line of Nathan Young (246-139), being partially fenced South 5 degrees 21 minutes 8 seconds West 586.26 feet to the point of beginning.  Containing 5.08 acres, more or less, as surveyed by Bartlett Surveying, 214 East Stevens Street, Cookeville, Tennessee, 38501, Ronald G. Taylor, R.L.S. #2123, on August 20,2008.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.  W&A No. 239253
