Successor Trustee Sale- Jessie & Misty Satterfield

NOTICE OF SUCCESSOR TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated October 15, 2013, executed by JESSIE T. SATTERFIELD AND WIFE, MISTY D. SATTERFIELD, conveying certain real property therein described to JOE CARTER, Trustee for Citizens Bank.  Said Deed of Trust is of record in Trust Deed Book 519, Page 366-369, Register’s Office, Macon County, TN; and
WHEREAS, Citizens Bank is the true and lawful holder of the debt, has declared the entire indebtedness due and payable, has appointed the undersigned, A. RUSSELL BROWN, as Successor Trustee by instrument filed for record in the Macon County Register of Deeds, and has instructed the Successor Trustee to foreclose said Deed of Trust in accordance with its terms and provisions; and
WHEREAS, a search of the public records at the time of the initial publication revealed no lien filed by the United States or the State of Tennessee which affects the above described property;
NOW, THEREFORE, by the authority vested in me as Successor Trustee, I will on the 10th day of December, 2015, at 10:00 o’clock a.m. at the Macon County Courthouse, Public Square, Lafayette, Tennessee, sell at public auction to the highest and best bidder for cash the following described property known as Map: 032 Parcel 019.01, situated in the 2ND Civil District, Macon County, TN;
BEING Tract #4 of the Ronnie Dixon Property and Being located in the 2nd Civil District of Macon County, Tennessee, bounded on the north by Verdie West and Tract #3 of the Dixon property (5.00 acres), on the east by said Tract #3 and Cold Springs Road, on the south by Cold Springs Road and Tract #5 of the Dixon property (5.00 acres), and on the west by said Tract #5, and being a portion of the property found in Deed Book 78, page 155, Register’s Office of Macon County, Tennessee.  See Tax Map 32, Parcel 19, Tax Assessor’s Office, Macon County, Tennessee, and more particularly described as follows:

Beginning at an iron pin in the west margin of Cold Springs Road, same being the northeast corner of this tract and the southern most corner of said tract #3, also being 650.00 feet south of the southern most corner of Cold Springs Cemetery as you measure along the west margin of Cold Springs Road, thence with said margin South 29 degrees 07 minutes 25 seconds West 133.75 feet to a point, same being point of curvature of a curve proceeding clockwise, having a deflection angle of 26 degrees 42 minutes 36 seconds, a radius of 564.71 feet, a tangent length of 134.07 feet, and chord of South 42 degrees 28 minutes 45 seconds West 260.88 feet, thence along said curve an arc length of 263.26 feet; thence South 55 degrees 50 minutes 00 seconds West 75.00 feet to an iron pin, thence leaving road with line of said Tract #5 North 36 degrees 28 minutes 30 seconds West 796.55 feet to an iron pin, thence with line of Verdie West South 86 degrees 35 minutes 10 seconds East 216.67 feet to an iron pin, thence with line of said Tract #3 South 63 degrees 45 minutes 55 seconds East 624.93 feet to the point of beginning, containing 5.00 acres more or less by survey by Carroll Carman, Registered Land Surveyor, Tennessee No. 910, dated May 2, 1988.
Being the same property conveyed to Jessie Thomas Satterfield and wife, Misty Satterfield from Patricia Bartley, Paul Howser, Jimmy Davis Satterfield and Jessie Thomas Satterfield, by Warranty Deed dated October 15, 2013, recorded October 17, 2013, at 2:51 p.m. in Deed Book 320, Page 199, Register’s Office of Macon County, Tennessee.

The physical address of this property is thought to be 2244 Cold Springs Road, Lafayette, TN  37083, but the property is being sold pursuant to the legal description and reliance on the physical address should not be made.
Said sale shall be to the highest bidder for cash in bar of all rights and equities of redemption, statutory or otherwise, homestead, dower, and all other rights or exemptions of every kind, all of which are expressly waived in said Deed of Trust. The title is believed to be good, but the undersigned will convey and sell only as Successor Trustee.  The property is sold as is, where is, without representations or warranties of any kind, including fitness for a particular use or purpose.  Said sale is subject to all matters shown on any recorded plat, any unpaid taxes, easements, covenants, any prior or superior liens or encumbrances, and to any matter that an accurate survey might disclose.  This sale is also subject to the rights of any person in possession.
If a high bidder fails to close a sale, the Successor Trustee shall have the option of making the sale to the next highest bidder who is able, capable, and willing to comply with the terms thereof.  The right is reserved to adjourn the sale to another day, place or time certain, without further publication, upon announcement of same at the time of adjournment.
