NOTICE OF SUBSTITUTE TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated February 12, 2019, executed by JOEL AARON SUTTON and TERRY MELISSA SUTTON conveying certain real property therein described as same appears of record in the Register`s Office of Macon County, Tennessee recorded February 15, 2019, in Deed Book RB72, Page 68; and
WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to PennyMac Loan Services, LLC who is now the owner of said debt; and
WHEREAS, the undersigned,Rubin Lublin TN, PLLC, having been appointed as Substitute Trustee by instrument to be filed for record in the Register’s Office of Macon County, Tennessee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that the undersigned, Rubin Lublin TN, PLLC, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee will, on November 14, 2023 at 2:00 PM at the Front Door of the Macon County Courthouse, 104 County Courthouse, Lafayette, TN 37083, proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Macon County, Tennessee, to wit:
Being a parcel of land located in the 8th Civil District of Macon County, Tennessee and being bounded on the South by Nichols Road, on the North and East by Beech One Properties, Inc., on the West by Dee E. and Joyce D. Wilburn, and being more particularly described as:
Beginning at a point in the Northerly margin of Nichols Road the center of a drain and being the southeast corner of Dee E and Joyce D. Wilburn Deed Book 161, Page 341, Register`s Office, Macon County, Tennessee; thence with the meanders of drain North 04 degree 08 minutes 04 seconds East, 189.03 feet to an iron pin; thence North 13 degrees 52 minutes 17 seconds West 279.31 feet to an iron pin at fence corner and dead tree in the southerly line of Beech One Properties, Inc., Deed Book 269, Page 433, Register`s Office of Macon County, Tennessee; thence with the property of aforementioned South 81 degrees 11 minutes 35 seconds East 205.14 feet to an iron pin; thence South 03 degrees 25 minutes 48 seconds East 428.12 feet to a power pole located in the northerly margin of Nichols Road; thence with the northerly margin of aforementioned South 89 degrees 41 minutes 33 seconds West 175.00 feet to the point of beginning.

Being the same property conveyed to Joel Aaron Sutton and wife, Terry Melissa Sutton by Warranty Deed from Fernando Pina and wife, Filomena Pina of record in Book RB72, page 66, Register`s Office for Macon County.
