Successor Trustee Sale – Teri and Ricky Gregory

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust dated December 21, 2011, executed by TERI GREGORY AND HUSBAND, RICKY GREGORY, conveying certain real property therein described to Donald W. Traylor, Trustee for Town and Country Finance Company of Lafayette, TN, with said Deed of Trust of record in Trust Deed Book 492, Page 293, Register’s Office, Macon County, Tennessee; and

WHEREAS, Town and Country Finance Company of Lafayette, TN, is the true and lawful holder of the debt, has declared the entire indebtedness due and payable, has appointed the undersigned, A. RUSSELL BROWN, as Successor Trustee by instrument filed for record in the Macon County Register of Deeds, and has instructed the Successor Trustee to foreclose said Deed of Trust in accordance with its terms and provisions; and

NOW, THEREFORE, by the authority vested in me as Successor Trustee, I will on
November 19, 2025, at 10:00 a.m., at the Macon County Administration Building, 201 Nature Trail Way, Lafayette, Tennessee 37083, sell at public auction to the highest and best bidder for cash the following described property:

Being known as Tract No. 4 of the Walrond property. Being located in the 1st Civil District of Macon County, Tennessee, on the southwest side of Long Creek Road, and being a portion of the property found in Deed Book 52, page 448, Register’s Office of Macon County, Tennessee. See Tax Map 31, Parcel 34, Tax Assessor’s Office Macon County, Tennessee, and more particularly described as follows:

BEGINNING at an iron pin in the southwest margin of Long Creek Road, same being the north most corner of this tract and the northeast corner of Leo Hire; thence with said margin South 67 degrees 14 minutes East 176:10 feet to a point, same being point of curvature of a curve proceeding clockwise, have a deflection angle of 15 degrees 25 minutes 52 seconds, a radius of 853.91 feet, a tangent length of 115.69 feet, and a chord of South 59 degrees 32 minutes East 229.28 feet; thence along said curve an arc length of 229.98 feet; thence south 51 degrees 49 minutes East 202.26 feet to a point; same being point of curvature of a curve proceeding counter-clockwise, have a deflection angle of 16 degrees 47 minutes 11 seconds, a radius of 351.47 feet, a tangent length of 51.86 feet, and a chord of South 60 degrees 12 minutes East 102.61 feet; thence along said curve an arc length of 102.97 feet; thence South 68 degrees 36 minutes East 125.61 feet to a point, said point being point of curvature of a curve proceeding clockwise, having a deflection angle of 51 degrees 59 minutes 05 seconds, a radius of 134.49 feet, a tangent length of 65.57 feet, and a chord of South 42 degrees 36 minutes East 117.88 feet; thence along said curve an arc length of 122.02 feet to an iron pin; thence with line of Tract #5 of the Walrond property (Lindsey) South 74 degrees 36 minutes West 1218.95 feet to a point in the center of Creek (passing a witnessed iron pin on the northeast bank of the creek); thence with centerline of creek and Hire line for the next two calls: North 35 degrees 45 minutes West 177.34 feet; thence North 50 degrees 58 minutes West 304,83 feet; thence North 35 degrees 32 minutes East 231.91 feet to an iron pin at stone (passing a witnessed iron pin at 25.00 feet); thence South 85 degrees 10 minutes East 163.50 feet to an iron pin; thence North 46 degrees 51 minutes East 518.30 feet to the point of beginning, containing 14.00 acres, more or less by survey by Carroll Carman, Registered Laud Surveyor, Tennessee Number 910, dated May 20, 1986.

Being the same property conveyed to Teri Gregory from Sherri Davis, by warranty deed
dated 8/3/11, recorded 8/3/11 in Deed Book 307, Page 328, and previously conveyed to
Carl Davis and wife, Sandra Davis from Jimmy Wilburn and Barry Witcher by deed
dated 6/13/03, recorded 6/13/03 in Deed Book 253, page 152, Register’s Office, Macon
County, Tennessee. The property passed by intestate succession to Sherri Davis and Teri
Gregory, sole heirs at law of Sandra Davis and Carl Davis. See affidavit of heirship of
Sandra and Carl Davis, of record in Misc Book 8, Page 87, said Register’s Office.
Ricky Gregory joins in this conveyance by virtue of marriage to Teri Gregory to convey
his marital interest in the above described property.

Said sale shall be to the highest bidder for cash in bar of all rights and equities of
redemption, statutory or otherwise, homestead, dower, and all other rights or exemptions of every kind, all of which are expressly waived in said Deed of Trust. The title is believed to be good, but the undersigned will convey and sell only as Successor Trustee. The property is sold as is, where is, without representations or warranties of any kind, including fitness for a particular use or purpose. Said sale is subject to all matters shown on any recorded plat, any unpaid taxes, easements, covenants, any prior or superior liens or encumbrances, and to any matter that an accurate survey might disclose. This sale is also subject to the rights of any person in possession.

If a high bidder fails to close a sale, the Successor Trustee shall have the option of making the sale to the next highest bidder who is able, capable, and willing to comply with the terms thereof. The right is reserved to adjourn the sale to another day, place, or time certain, without further publication, upon announcement of same at the time of adjournment.
