Schwab Files Suit Against Mayor & County Attorney

It looks like it’s full speed ahead with Media versus Mayor.  Michael Schwab of My Macon TV is taking Macon County Mayor Shelvy Linville and County Attorney E. Guy Holliman to court under Tennessee’s open records law.  Filed with the Circuit Court of Macon County on January 14th, My Macon Tv’s Michael Schwab petitioned the court for an order requiring respondents to comply with the written request for public records issued to it on three different dates in December 2009 and January 2010. 

Schwab, the petitioner, requests that the court issue and order the respondent to immediately appear and show cause, if any they may have, why the petition should not be granted, that the Court direct the Respondent to allow the Petitioners full and complete access to all requested items including but not limited to, the information packets given to County Commissioners prior to each meeting, the Macon County Budget for 2008-2009, and Mayor Linville’s Expense reports.  Schwab also requests that the court order the Mayor, to make available to the public, all future packets and documentation given to County Commissioners, as required by T.C. A. 10-7-503 (2) (B) and that the court award petitioners reasonable fees and cost in accordance with TCA 10-7-502, if the actions of respondents in failing to disclose the public records were willful and that the petitioner be awarded such other and further relief as to which they may be entitled.

A hearing has been set for this Friday, January 22, 2010 at 9 a.m. in Lebanon, Tn. with Judge Clara Byrd presiding.
