NOTICE OF TRUSTEE'S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated June 15, 2001, and the Deed of Trust of even date securing the same, recorded June 22, 2001, in Book No. TD290, at Page 208, in Office of the Register of Deeds for Macon County, Tennessee, executed by Marvin Simons, Jr. and Teresa Simons, conveying certain property therein described to Brenda R. Lehman as Trustee for Southstar Funding, LLC dba Capital Home Mortgage; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Deutsche Bank Trust Company Americas formerly known as Bankers Trust Company, as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2001-KS3.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Deutsche Bank Trust Company Americas formerly known as Bankers Trust Company, as Trustee for Residential Asset Securities Corporation, Home Equity Mortgage Asset-Backed Pass-Through Certificates, Series 2001-KS3, will, on March 19, 2015 on or about 12:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:

Being located in the 11th Civil District, Macon County, Tennessee, and the 12th Civil District, Sumner County, Tennessee, on the East side of Bear Carr Road, and being a portion of the property found in Deed Book 57, Page 280, Register's Office, Macon County, Tennessee. See Tax Map 54, Parcel 26, Tax Assessor's Office, Macon County, Tennessee, and Tax Map 46, Parcel 3, Tax Assessor's Office, Sumner County, Tennessee, and more particularly described as follows:    Beginning at an iron pin in the East margin of Bear Carr Road, same being the Northwest corner of this tract and the Southwest corner of Tract Number 8 of the Simons property (5.01 acres as per survey of same date), also being 1405.06 feet South of the Southwest corner of Connie Jenkins as you measure along said margin; thence leaving road with line of said Tract Number 8 South 85 degrees 50 minutes 17 seconds East 1183.97 feet to an iron rod; thence with line of Marvin Simons South 01 degrees 17 minutes 56 seconds West 94.70 feet to an iron rod at a post; thence with line of W. L. Meador, South 00 degrees 46 minutes 24 seconds West 88.92 feet to an iron rod; thence with line of Tract Number 10 of the Simons property (5.01 acres as per survey of same date), North 85 degrees 50 minutes 17 seconds West 1197.08 feet to an iron rod in the East margin of Bear Carr Road; thence with said margin North 05 degrees 08 minutes 09 seconds East 183.37 feet to the point of beginning, by survey by Carroll Dean Carman, Registered Land Surveyor, Tennessee Number 910, address 150 Middle Fork Road, Hartsville, Tennessee - 37074, dated August 19, 1993.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:
