NOTICE OF TRUSTEE'S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated August 1, 2007, and the Deed of Trust of even date securing the same, recorded August 7, 2007, in Book No. TD427, at Page 415,   in Office of the Register of Deeds for Macon County, Tennessee, executed by Crystal McCarter and Michael W. McCarter, conveying certain property therein described to David Dehart and Andrew Standford as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for First National Bank, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wells Fargo Bank, N.A..
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wells Fargo Bank, N.A., will, on January 26, 2016 on or about 12:00 PM, at the Macon County Courthouse, 104 County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:

Beginning at an iron pin old in the northerly line of Langford Road, being the southeast corner of this tract and also a corner to the remaining David Powell property, and also being North 65 degrees 44 minutes 37 seconds West 385.25 feet to an iron pin old at the corner of Joel Powell as described in Deed Book 258, Page 144; thence leaving the remaining Powell property with the northerly line of Langford Road North 67 degrees 00 minutes 24 seconds West 150.19 feet to an iron new, being a corner to the remaining David Powell property; thence leaving the northerly line of Langford Road with a line servering the Powell property North 15 degrees 15 minutes 14 seconds East 474.79 feet to an iron pin new; thence South 81 degrees 21 minutes 01 seconds East 149.91 feet to an iron pin old; thence South 15 degrees 15 minutes 54 seconds West 512.26 feet to the point of beginning containing 1.69 acres more or less. Being the same property conveyed to Michael McCarter and wife, Crystal McCarter, as tenants in common with rights of survivorship in Warranty Deed, as filed at Book WD285, Page 44 in the Register’s Office of Macon County.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.  W&A No. 310873
