NOTICE OF TRUSTEE'S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated August 5, 2002, and the Deed of Trust of even date securing the same, recorded August 8, 2002, in Book No. TD312, at Page 119, in Office of the Register of Deeds for Macon County, Tennessee, executed by Shirley E. Coley and Bobby H. Coley, conveying certain property therein described to Arnold M. Weiss, Attorney as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Home Loans, Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by PennyMac Loan Services, LLC.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by PennyMac Loan Services, LLC, will, on March 8, 2016 on or about 12:00 PM, at the Macon County Courthouse, 104 County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Land in the 11th Civil District, Macon County, Tennessee, described as part of the Lorene Johns Property (also being Tract No. 3 of the Arlis Howell Land) according to a November 13, 1979, Survey by Joe E. Holland, Tennessee Registered Land Surveyor No. 492, as follows: Beginning at a stake on the easterly margin of Epperson Springs Road located northwardly 488.0 feet from the northwesterly corner of the Junior Sullivan Property, said corner also being the original southwesterly corner of the Lorene Johns Property; thence with said margin, N 25 degrees 30 minutes E 218.0 feet to a stake; thence S 85 degrees 00 minutes E 1100.0 feet, plus or minus, to a stake in the westerly line of Billy Tuttle property; thence, with said line, S 2 degrees 20 minutes W 200.0 feet to a stake; thence N 84 degrees 30 minutes W 825.0 feet, plus or minus, to a stake near a barn; thence, N 86 degrees 00 minutes W 360.0 feet to the point of beginning. Being the same property conveyed to Bobby H. Coley and wife, Shirley E. Coley in Warranty Deed, as filed at Book WD247, Page 364 in the Register’s Office of Sumner County.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
