NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions and payments made and provided for in a Deed of Trust executed by Daniel Pedigo and Sandra Whitehead, which Deed of Trust is of record in Trust Deed Book 416, page 59, Register’s Office of Macon County, Tennessee, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust, and payment not having been made as demanded, notice is hereby given that I, Christi L. Dalton, Substitute Trustee, under the power and authority vested in me by Appointment of Substitute Trustee of record in Record Book 17, page 391, ROMCT, and having been requested so to do by the lawful owner and holder of said debt, will on Thursday, February 25, 2016, at 11:00 a.m. at the front door of the Courthouse in Macon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described parcel of land in the 11th District of Macon County, Tennessee:

The above described tract is encumbered by an ingress and egress easement to benefit tract 3 and also encumbered by and benefited by an egress and ingress easement to Hall Lane, and encumbered by a 20 foot utility easement as described in Deed Book 416, page 59, Register’s Office, Macon County, Tennessee.
The above property is subject to restrictions of record in Deed Book 281, page 229, Register’s Office, Macon County, Tennessee.
This is the same property which was conveyed to Daniel Pedigo and Sandra Whitehead by deed from Hillas Swindle and wife, Elizabeth Swindle, and David Swindle and wife, Morrisa Swindle, and F.D. Fuqua dated January 31, 2007, of record in Deed Book 281, page 227, Register’s Office, Macon County, Tennessee.  
The street address of the above described property is believed to be 529 Hall Lane, Lafayette, Tennessee, 37083, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
If applicable, the notice requirements of T.C.A. 35-5-117 have been met.
The right is reserved to adjourn the day of the sale to another day at a time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
The property is to be sold “AS IS, WHERE IS,” without representation or warranty of any kind whatsoever, whether express or implied.  Without limiting the foregoing, THIS PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
This sale will be made subject to all unpaid taxes and any liens or encumbrances which take priority as a matter of law. A deposit of Ten (10%) percent of the purchase price will be required to be paid at the sale.
