NOTICE OF FORECLOSURE SALE  STATE OF TENNESSEE, MACON COUNTY
WHEREAS, Billy R. Farless executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc., as nominee for CMG Mortgage, Inc., d/b/a CMG Financial , #1820, Lender and Realty Title & Escrow Company, Inc., Trustee(s), which was dated October 17, 2016 and recorded on October 24, 2016 in Book RB29, Page 622, Macon County, Tennessee Register of Deeds.
WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Tennessee Housing Development Agency, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on June 19, 2018, at 1:00PM at the usual and customary location at the Macon County Courthouse, Lafayette, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Macon County, Tennessee, to wit:
Land being a certain tract or parcel of land in the Eleventh Civil District of Macon County, Tennessee, being more particularly described as follows, to-wit:
Portion of deed recorded in Deed Book 113, Page 140, Register's Office, Macon County, Tennessee and;
Lying and Being in the 11th Civil District of Macon County, Tennessee and beginning on a steel pin in the North margin of the Oak Dale Road, the Southeast corner of this plot and Southeast corner of the above mentioned deed, running with said deed North 85 degrees 21 minutes West 200.1 feet to a steel pin, North 4 degrees 11 minutes East 435.4 feet to a stake (call erroneously omitted in prior deed); thence a line bisecting said deed South 85 degrees 21 minutes East 200.1 feet (call erroneously omitted in prior deed) to a stake; thence with the East boundary of said deed South 4 degrees 11 minutes West 435.4 feet to the beginning by description taken from a survey done by Joe E. Holland, Registered Land Surveyor #492 on January 8, 1981.
Being the same property conveyed to Billy R. Farless, an unmarried man by deed from William Akers and Lisa A. Akers, husband and wife, of record in Book RB 29, page 620-621, Register's Office for Macon County, Tennessee.
Subject to all easements, restrictive covenants and conditions, and other matters of record, including all items set out on any applicable plat of record.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and
All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
