Notice of Sale- Terry Strong

NOTICE OF SALE
WHEREAS, by Deed of Trust dated January 16, 2016, of record at Record Book 18, pages 159-161, Register’s Office of Macon County, Tennessee, Terry Strong, conveyed in trust to James D. White, Jr., Trustee, that property hereinafter described to secure the payment of a certain promissory note; and WHEREAS, David Powell, is presently the owner and holder of said Promissory Note and Deed of Trust above referred to, securing the indebtedness therein mentioned; and
WHEREAS, default has occurred under the terms of the Promissory Note and the Deed of Trust, thereby necessitating foreclosure, and David Powell, has directed James D. White, Jr., as Trustee, to immediately commence foreclosure on the subject property;
NOW THEREFORE this Trustee’s Notice of Sale, default having occurred in the payment of the Promissory Note according to the terms and conditions thereof, and the Promissory Note being in default, the undersigned, James D. White, Jr., Trustee, does hereby give notice that he, as attorney, and/or agent, will sell the hereinafter described property on July 25, 2019, at the hour of 1:00 p.m., at the South door of the Courthouse in Lafayette, Macon County, Tennessee, to the last, highest and best bidder, for cash in hand and free from the rights of redemption, homestead, and dower, and all other exemptions of any kind, but subject to any delinquent or current real property taxes on the property, and any valid mineral and/or oil and gas leases. The property to be sold is described as follows, lying and being in the 6th Civil District of Macon County, Tennessee, and more particularly described as follows, to-wit:
TRACT NO. 7: of the Roger and Sue Hix Survey (7.33 acres) prepared by Holland Land Surveying on 4/27/2000 more particularly described as follows:
BEGINNING at an iron pin new in the south margin of Gas Hollow Road, being the northeast corner of this tract and also a corner to tract 2 of the Roger and Sue Hix property and 272.12 feet west of an iron pin at the corner of Alton Parks property; thence leaving the road with tract 2 south 11 degrees 22 minutes 01 seconds west 443.10 feet to a to an iron pin new; thence south 76 degrees 48 minutes 14 seconds east 131.81 feet to an iron pin new; thence south 76 degrees 48 minutes 14 seconds east 131.81 feet to an iron pin new, being in the line of Alton Parks; thence with Parks south 10 degrees 21 minutes 36 seconds west 413.96 feet to a 12” walnut tree; thence south 10 degrees 07 minutes 13 seconds west 244.19 feet to a dead snag; thence south 07 degrees 47 minutes 57 seconds west 120.07 feet to a 15” cedar tree; thence south 13 degrees 31 minutes 50 seconds west 80.80 feet to an iron pin new by a hackberry tree; thence south 61 degrees 25 minutes 34 seconds west 65.56 feet to a 12” cedar tree; thence south 74 degrees 52 minutes 51 seconds west 255.75 feet to a 20” mulberry, also being a corner to tract 8 of the Roger and Sue Hix property; thence with tract 8 north 05 degrees 22 minutes 18 seconds east 491.31 feet to an iron pin new; thence 11 degrees 22 minutes 01 second east 964.88 feet to an iron pin new in the south margin of Gas Hollow Road; thence with the south margin of Gas Hollow Road north 87 degrees 02 minutes 15 seconds east 51.60 feet to the point of beginning containing 7.33 acres more or less.
Included in the above described 7.33 acre tract is a 50 feet wide rightof- way easement through tract 7 to benefit tract 8, 9, 10 and 11 of theRoger and Sue Hix property and is described as follows: BEGINNING at an iron pin new at the south margin of Gas Hollow Road, being the northwest corner of tract 2 of the Roger and Sue Hix property; thence a line described the easterly baseline of said easement with tract 7 south 11 degrees 22 minutes 01 seconds west 443.10 feet to a post; thence south 11 degrees 21 minutes 59 seconds west 22.30 feet to a point; thence with the south base of said easement south 87 degrees 36 minutes 15 seconds west 51.48 feet to a point in the line of tract 8.
And being the same lands conveyed to Terry Strong and wife, Lori Strong, from Wayne Wright and David Painter by warranty deed dated July 20, 2000, and recorded in Deed Book 235, pages 147-149, Register=s Office of Macon County, Tennessee; and being the same lands wherein Lori Strong conveyed all her right, title and interest to Terry Strong by quitclaim deed dated January 28, 2016, and recorded in Record Book 18, page 157, Register=s Office of Macon County, Tennessee.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants; easements, or set back lines that may be applicable; any statutory rights or redemption of any Governmental Agency, State or Federal; any prior liens or encumbrances as well as any priority created by fixture filing; to any matter that an accurate survey of the premises might disclose; and subject to, but not limited to the following parties who may claim an interest in the above referenced property; Terry Strong and David Powell, and subject to any party who may claim an interest in the above referenced property.
The sale held pursuant to this notice may be rescheduled at the Trustee’s option at any time.
