Substitute Trustee Sale Rural Developments, LLC

NOTICE OF FORECLOSURE
WHEREAS, RURAL DEVELOPMENTS, LLC  by a Deed of Trust dated the 29th  day of September, 2006, and of record in Trust Deed Book 408, page 342, in the Register’s Office of  Macon County, Tennessee, conveyed to JOE CARTER, Trustee, an interest in and to the hereinafter described property to secure the payment of a Promissory Note described in said Deed of Trust, which Note is presently held and owned by CITIZENS BANK; and
WHEREAS, by Appointment of Substitute Trustee dated April 25, 2014 and of record in Trust Deed Book 526, pages 454-455, Register’s Office of Macon County, Tennessee CITIZENS BANK appointed PHILIP KELLY, as Substitute Trustee; and
WHEREAS, demand has been made for the payment of the aforesaid Note secured by the above-described Deed of Trust which Note is in default; and
WHEREAS, CITIZENS BANK, the owner and holder of said note has demanded that the property be advertised and sold in satisfaction of said indebtedness including the costs of foreclosure, in accordance with the terms of said Note and of the Deed of Trust; and 
NOW, THEREFORE, notice is hereby given that I, PHILIP KELLY, Substitute Trustee, pursuant to the power, duty and authority vested in and imposed upon me in the above-described Deed of Trust, will on Friday, September 12, 2014 @ 10:15 o’clock A. M., in the center hall of the Macon County Courthouse, in Lafayette, Tennessee offer for sale to the highest and best bidder for cash and free from all rights and equities of redemption, statutory or otherwise, homestead, dower, marital share and all other rights and exemptions of every kind, but only as and to the extent any rights or equities or redemption are effectively waived or terminated in said Deed of Trust, certain real property situated in Macon County, Tennessee, as follows:

Lying and being in the 6th Civil District of Macon County, Tennessee, being Lot Number 2 of the Simmons Lake Subdivision, a plat of which is of record in Plat Cabinet 1, Slide 180-B, Register’s Office Macon County, Tennessee.  And more fully described as follows:
Beginning at an iron pin found on the south right-of-way of Old Lake Road and also being the northwest corner of the Samantha Hayes Property as recorded in Deed Book 229, Page 354, ROMCT; thence South 48 degrees 17 minutes 04 seconds West a distance of 301.66 feet to an iron pin found; thence with the lines of the Great Spring Waters of America, Inc. Lying and being in the 6th Civil District of Macon County, Tennessee, being Lot Number 4 of the Simmons Lake Subdivision, a plat of which is of record in Plat Cabinet 1, Slide 180-B, Register’s Office Macon County, Tennessee.  And more fully described as follows:

The address of the above described property is Old Lake Road, Red Boiling Springs, TN  37150.

Said sale will be subject to any and all unpaid taxes that may be a lien against the property and any and all other liens or other rights which take priority over the Deed of Trust upon which this foreclosure sale is had.
