Substitute Trustee Sale Rural Developments, LLC

NOTICE OF FORECLOSURE

WHEREAS, RURAL DEVELOPMENTS, LLC  by a Deed of Trust dated the 7th   day of March, 2008, and of record in Trust Deed Book 439, page 124, in the Register’s Office of  Macon County, Tennessee, conveyed to JOE CARTER, Trustee, an interest in and to the hereinafter described property to secure the payment of a Promissory Note described in said Deed of Trust, which Note is presently held and owned by CITIZENS BANK; and
WHEREAS, by Appointment of Substitute Trustee dated April 25, 2014 and of record in Trust Deed Book 527, pages 15-16, Register’s Office of Macon County, Tennessee CITIZENS BANK appointed PHILIP KELLY, as Substitute Trustee; and
WHEREAS, demand has been made for the payment of the aforesaid Note secured by the above-described Deed of Trust which Note is in default; and
WHEREAS, CITIZENS BANK, the owner and holder of said note has demanded that the property be advertised and sold in satisfaction of said indebtedness including the costs of foreclosure, in accordance with the terms of said Note and of the Deed of Trust; and 
NOW, THEREFORE, notice is hereby given that I, PHILIP KELLY, Substitute Trustee, pursuant to the power, duty and authority vested in and imposed upon me in the above-described Deed of Trust, will on Friday, September 12, 2014 @ 10:00 o’clock A. M., in the center hall of the Macon County Courthouse, in Lafayette, Tennessee offer for sale to the highest and best bidder for cash and free from all rights and equities of redemption, statutory or otherwise, homestead, dower, marital share and all other rights and exemptions of every kind, but only as and to the extent any rights or equities or redemption are effectively waived or terminated in said Deed of Trust, certain real property situated in Macon County, Tennessee, as follows:

Parcel 19:
Lying and being in the 6th Civil District of Macon County, Tennessee and beginning at an iron pin in the west margin of Lake Road, being the southeast corner of this tract of land and the northeast corner of Old Colonial Hotel property also 231.32 feet north of the southeast corner of the Old Colonial Hotel property at Highway 52; thence with the Old Colonial Hotel property and other McClellan heir property N88 W526.08 feet to an iron pin in the west margin of College Street; thence with College Street N88 W15 feet; thence with College Street N14 -37E 522.22 feet; thence with College Street N14 -31E 496.00 feet to the intersection of Lake Road; thence with Lake Road S17- 53 East 60.26 feet; thence with Lake Road S0 – 08E 599.70 feet; thence with Lake Road N88 W15 feet to the beginning, containing 8.45 acres, more or less.

INCLUDED in the above description but EXCLUDED from this conveyance is a small portion of land taken by the State of Tennessee for construction, maintenance and use as a highway bridge of Lake Road at the creek.
INCLUDED in the above description but EXCLUDED from this conveyance is a small portion of land containing 0.38 acres deeded to Dickie Claywell on 4/7/97, recorded 4/18/97 in Deed Book 210, Pages 246, in the Register’s Office for Macon County, Tennessee.
BEING the same property conveyed to Rural Developments, LLC from David Crowe and wife, Pamela Crowe and James Ritter and wife, Anna Ritter, by warranty deed dated September 19, 2007, recorded in Deed Book 285, Page 358, in the Register’s Office for Macon County, Tennessee.

Said sale will be subject to any and all unpaid taxes that may be a lien against the property and any and all other liens or other rights which take priority over the Deed of Trust upon which this foreclosure sale is had.
