NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated January 8, 2010, and the Deed of Trust of even date securing the same, recorded January 21, 2010, at Book TD468, Page 402 in Office of the Register of Deeds for Macon County, Tennessee, executed by Kent R. Bolton and Jennifer L. Bolton, conveying certain property therein described to Southeast Title of Tennesse, Inc. as Trustee for Fifth Third Mortgage Company; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on November 6, 2014 on or about 12:00 P.M., at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
A certain tract or parcels of land in the 7th Civil District of Macon County, Tennessee as follows:
Tract Number 3 (0.88 acres) of the Burgess/Russell property: Being located in the 7th Civil District, Macon County, Tennessee, on the South side of Highway 56, and being a portion of the property found in Deed Book 105, Page 45, Register’s Office, Macon County, Tennessee, also being Tract Number 3 of the Burgess-Russell property of record in Plat Cabinet 2, Slide 1-A, Register’s Office, Macon County, Tennessee. See Tax Map 81, Parcel 77, Tax Assessor’s Office, Macon County, Tennessee, and more particularly described as follows:
Beginning at an iron rod in the South margin of Highway 56, same being the Northwest corner of this tract and the Northeast corner of Tract Number 4 of the Burgess-Russell property (1.52 acres as per survey of same date), also being 1259.13 feet Northeast of the Northeast corner of Vella M. Davis as you measure along said margin; thence with said margin along a curve proceeding clockwise, having a deflection angle of 1 degree 31 minutes 44 seconds, a radius of 1961.50 feet a tangent length of 26.17 feet and a chord of North 44 degrees 57 minutes 13 seconds East 52.34 feet thence along said curve an arc length of 52.34 feet to a point, same being point of curvature of a curve proceeding clockwise, having a deflection angle of 58 degrees 49 minutes 35 seconds, a radius of 137.20 feet a tangent length of 77.35 feet and a chord of North 75 degrees 07 minutes 52 seconds East 134.76 feet; thence along said curve an arc length of 140.87 feet; thence South 75 degrees 27 minutes 20 seconds East 96.66 feet thence South 74 degrees 35 minutes 06 seconds East 25.00 feet to an iron rod in said margin; thence leaving road with line of Tract 02 of the Burgess-Russell property (1.69 acres as per survey of same date) South 15 degrees 24 minutes 54 seconds West 214.75 feet to an iron rod; thence with line of said Tract Number 4 North 53 degrees 51 minutes 58 seconds West 282.06 feet to the point of beginning containing 0.88 acres more or less by survey by Carroll Dean Carman, Registered Land Surveyor, Tennessee Number 910, address 150 Middle Pork Road, Hartsville, Tennessee, 37074, dated September 11, 1998.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
