Notice of Trustee’s Sale Audrey & Chris Gordy

NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated January 31, 2005, and the Deed of Trust of even date securing the same, recorded February 3, 2005, at Book TD371, Page 229 in Office of the Register of Deeds for Macon County, Tennessee, executed by Audrey Gordy and Curtis Gordy, conveying certain property therein described to Donoho, Taylor and Taylor as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for NBANK, NA, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on December 11, 2014 on or about 12:00 P.M., at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:

Lying and being in the 6th District of Macon County, Tennessee, as follows:
Tract No. 1:
Lying and being in the 6th Civil District of Macon County, Tennessee, and located in the Town of Red Boiling Springs, and being a house and lot on Mill Street, described as follows:
Beginning on a stone 10 feet 3 inches South of a black walnut; formerly C. W. Jordan corner, now Davis corner; thence West 52 feet to a stake in Clark line; thence North 2 East 150 feet with Clark line to a stake; thence East 60 feet to a stake formerly Jordan corner, now Davis corner; thence with the Davis line South 2 West 150 feet to the beginning.

Tract No. 2:
Lying and being in the 6th Civil District of Macon County, Tennessee, and located in the Town of Red Boiling Springs, Tennessee, and beginning at a stake in line of Clark and Moss; thence up the hill 100 feet to a stake in Moss and Clark’s line, thence down the hill with Clark’s line to Clark’s new corner; thence with Mell Clark’s line to the beginning corner.
There is also conveyed by this deed, the right in the Grantee to use the existing driveway for ingress and egress to and from a garage building, the right of way to remain where it is presently located.
Included in the above description, but excluded from this conveyance is the following:

Beginning on a nail in the pavement at the North right of way of McClure Street, being the Southeast corner of this tract, a point in the boundary of a tract of land belonging to Glen and Melba Russell, and a point in the outer perimeter of the parent tract; thence leaving the boundary of Russell, and with the North right of way of McClure Street North 80 degrees 15 minutes 35 seconds West 46.00 feet to a 1/2 inch pipe set at the right of way, the Southwest corner of this tract, and a point in the outer perimeter of the parent tract; thence leaving the right of way and severing the parent tract North 7 degrees 40 minutes 31 seconds East 138.83 feet to a 1/2 inch pipe set in a fence line, the Northwest corner of this tract, a point in the boundary of the aforementioned tract of land belonging to Glen and Melba Russell and a point in the outer perimeter of the parent tract; thence with the fence line and the line of Russell South 87 degrees 12 minutes 25 seconds East 46.00 feet to a 1/2 inch pipe set at the East end of the fence line the Northeast corner of this tract; thence leaving the fence line, and continuing with the line of Russell South 7 degrees 37 minutes 15 seconds West 144.40 feet to the point of beginning, containing 0.1492 acres.  See Deed Book 209, Page 98, Register’s Office of Macon County, Tennessee.

Also included in the above description, but excluded from the conveyance is a 150 square feet conveyed to the City of Red Boiling Springs, Tennessee, of record in Deed Book 137, Page 201, Register’s Office of Macon County, Tennessee.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:  Audrey Gordy; Curtis Gordy; Jennifer King
The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.  W&A No. 1286 251266
