Notice of Trustee Sale – Frank & Jaclyn Falor

NOTICE OF TRUSTEE’S SALE

Default having been made in the terms, conditions and payments made and provided for in a Deed of Trust executed by Frank D. Falor and wife, Jaclyn Falor, which Deed of Trust is of record in Trust Deed Book 446, page 79, Register’s Office of Macon County, Tennessee, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust, and payment not having been made as demanded, notice is hereby given that I, Radford A. West, Trustee, under the power and authority vested in me and having been requested so to do by the lawful owner and holder of said debt, will on Friday, July 24, 2015, At 10:00 a.m. at the front door of the Courthouse in Macon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described parcel of land in the 5th District of Macon County, Tennessee:

TRACT #42:
Being located in the 5th Civil District of Macon County, Tennessee southeast of Green Valley Road and on the northeast side of Hale gravel access road and being more particularly described as follows: Being Lot 42 of the Hale property of record in Plat Cabinet 1, Slide 169 A&B, Register’s Office for Macon County, Tennessee, described in metes and bounds as follows: Beginning at an iron pin in the southwest margin of Hale gravel access road, same being the northeast corner of this tract and the southeast corner of Tract #43 of the Hale property (1.39 acres as per survey of same date) also being 1038.52 feet southeast of the southeast margin of Green Valley Road as you measure along the southwest margin of Hale gravel access road; thence with said margin South 18 degrees 23 minutes 05 seconds East 200.00 feet to an iron pin in said margin; thence leaving road with line of Tract #41 of the Hale property (1.93 acres as per survey of same date) South 70 degrees 41 minutes 25 seconds West 422.08 feet to an iron pin; thence with line of Tract #49 (3.48 acres) and Tract #48 (3.21 acres) of the Hale property North 9 degrees 51 minutes 00 seconds East 229.00 feet to an iron pin; thence with line of said Tract #43 North 70 degrees 41 minutes 25 seconds East 313.73 feet to the point of beginning containing 1.69 acres more or less by
survey by Carroll Carman, Registered Land Surveyor, Tennessee Number 910, address Route 1 Box 35A, Hartsville, TN, 37074, dated June 23, 1989.

Access to the above tract is provided by Hale gravel access road which leads from Green Valley Road to Oak Knob Road, and being 50-foot wide dedicated right of way. Being the same property conveyed to Frank D. Falor and wife, Jaclyn Falor by deed from Kerry Cothron and wife, Virginia Cothron, dated July 18, 2008, of record in Deed Book 290, page 360, Register’s Office, Macon County, Tennessee. The above described property is subject to restrictions of record in Deed Book 193, page 355, ROMCT, and any easements or other matters of record in Plat Cabinet 1, Slide 169 A&B, ROMCT.

The street address of the above described property is believed to be 226 Sparrow Road, Lafayette, Tennessee, 37083, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control. If applicable, the notice requirements of T.C.A. 35-5-117 have
been met.

Interested Parties: Macon Bank & Trust Company, Lafayette, Tennessee, is the holder of the note which the Deed of Trust secures. Virginia Cothron is believed to be the holder of a second mortgage note secured by the above  property. The right is reserved to adjourn the day of the sale to another day at a time certain, without further  publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above. The property is to be sold “AS IS, WHERE IS,” without representation or warranty of any kind whatsoever, whether express or implied. Without limiting the foregoing, THIS PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE. This sale will be made subject to any unpaid taxes and any liens or encumbrances which take priority as a matter of law.

A deposit of Ten (10%) percent of the purchase price will be required to be paid at the sale with the balance due within Three (3) business days. Insertion dates: June 30, 2015, July 7, 2015, and July 14, 2015
