NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated September 20, 2007, and the Deed of Trust of even date securing the same, recorded September 26, 2007, in Book No. TD431, at Page 23,  in Office of the Register of Deeds for Macon County, Tennessee, executed by Jillian Dean and Phillip Dean, conveying certain property therein described to Stewart Title Company as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Optima Mortgage Corporation, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Nationstar Mortgage, LLC.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Nationstar Mortgage, LLC, will, on August 20, 2015 on or about 12:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:

TRACT NO. 1: Lying and being the 4 th  Civil District of Macon County, Tennessee, as follows: Beginning at an iron rod in the south boundary of Bobby Perkins same being the northeast corner of this tract and a corner to Irene Earps, also being South 82 degrees 05 minutes 00 seconds East 800.00 feet from the center of Pumpkin Branch Road as you measure the south boundary of Perkins; thence with line of Irene Earps South 24 degrees 08 minutes 38 seconds East 125.00 feet to a 20 inch elm tree; thence North 82 degrees 42 minutes 46 seconds West 168.87 feet to an iron rod in the northeast margin of Pumpkin Branch Road; thence North 82 degrees 42 minutes 46 seconds West 29.22 feet to a point in the center of Pumpkin Branch Road; thence with center of road and then leaving road to the south boundary of Perkins, North 39 degrees, 54 minutes, 01 seconds West 161.00 feet to a point; thence with line of Perkins South 82 degrees 05 minutes 00 seconds East 251.03 feet to the point of beginning, containing 0.554 acre, more or less by survey by Carroll Dean Carman, Registered Land Surveyor, Tennessee Number 910, address 150 Middle Fork Road, Hartsville, Tennessee, 37074, dated June 6,1994. Subject to the county road right of way of Pumpkin Branch Road, if any. TRACT NO. 2: Being located in the 3 rd  Civil District, Trousdale County, Tennessee, and the 4 th  Civil District of Macon County, Tennessee, on the northeast side of Pumpkin Branch Road, and being a protion of the property of record in Deed Book 44, Page 310, Register’s Office of Trousdale County, Tennessee, See Tax Map 12, Parcel 3.00 P/O, Tax Assessor’s Office, Trousdale County, Tennessee and Tax Map 89, Parcel 2.00 P/O, Tax Assessor’s Office Macon County, Tennessee, and more particularly described as follows: Beginning at an iron rod in the northeast margin of Pumpkin Branch Road, same being the westernmost corner of this tract and the southwest corner of the Richard B. Roark property (see Deed Book 202, Page 177, ROMCT); thence leaving road with line of Richard B. Roark property South 82 degrees 42 minutes 46 seconds East 168.87 feet to a 20-inch elm tree; thence North 24 degrees 08 minutes, 38 seconds West 125.00 feet to an iron rod; thence with line of Bobby Perkins South 82 degrees 22 minutes 21 seconds East 471.65 feet to an iron rod; thence with line of Irene and Ronnie Earps South 67 degrees 02 minutes 17 seconds West 488.88 feet to an iron rod in the northeast margin of Pumpkin Branch Road; thence with said margin North 39 degrees 46 minutes 00 seconds West 209.04 feet to the point of beginning, containing 1.50 acres more or less by survey by Carrroll Dean Carman, registered Land Surveyor, Tennessee Number 910, address 150 Middle Fork Road, Hartsville, Tennessee, 37074, dated December 3, 2001. The above described tract lies in both Trousdale County and Macon County Tract No. 2 has not been approved by the Macon County Planning Commission and cannot be conveyed by itself as a building lot. BEING the same property conveyed to Phillip Dean and wife, Jillian Dan by deed dated September 4, 2003 from Richard B. Roark and wife, Penny D. Roark of record in Deed Book 254, Page 448, Register’s Office of Macon County, Tennessee, and in Record Book 5, Page 288, Register’s Office of Trousdale County, Tennessee. Being the same property conveyed to Jillian Dean in Quit Claim Deed, as filed at Book WD307, Page 395 in the Register’s Office of Macon County.
LESS AND EXCEPT THE PORTION OF THE PROPERTY RESIDING IN TROUSDALE COUNTY, TENNESSEE.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.  W&A No. 306534
