Trustees Sale – Wendy & Garry Gentry


WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated April 24, 2007, and the Deed of Trust of even date securing the same, recorded April 26, 2007, in Book No. TD421, at Page 378,  in Office of the Register of Deeds for Macon County, Tennessee, executed by Wendy Gentry and Garry Gentry, conveying certain property therein described to Affiliated Title Insurance Co as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for M&T, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by M & T Bank.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by M & T Bank, will, on August 13, 2015 on or about 12:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Lying and being in the 10th Civil District of Macon County, Tennessee, being described by metes and bounds and follows: Beginning at an iron pin, being the Northeast corner of this tract and the South right-of-way of Highway 52 (65 South of centerline at station 250+30); thence with the South right-of-way of New Highway 52, South 20 degrees 37 minutes 05 seconds West 63.49 feet to an iron pin at the right-of-way of Old Highway 52; thence with the North right-of-way of Old Highway 52, South 53 degrees 44 minutes 47 seconds West 166.35 feet to a point; South 57 degrees 54 minutes 05 seconds West 48.29 feet to a point; South 64 degrees 01 minutes 31 seconds West 92.31 feet to a point; South 79 degrees 15 minutes 16 seconds West 79.10 feet to a point; North 89 degrees 26 minutes 08 seconds West 135.66 feet to an iron pin, being at the South right-of-way of new Highway 52; thence with the South right-of-way of New Highway 52, North 52 degrees 14 minutes 26 seconds East 68.29 feet to an iron pin; North 66 degrees 02 minutes 04 seconds East 481.27 feet to the point of beginning, containing 0.80 acres, more or less, according to a survey by Joe E. Holland, Registered Land Surveyor, Tennessee No. 492, address 606 Red Boiling Spring Road, Lafayette, Tennessee 37083, dated January 28, 1992. Subject to any applicable governmental zoning ordinances or subdivision regulations in effect thereon. Subject to oil and gas lease in Lease Book 12, Page 215, recorded on July 30, 1980, and assignments thereto. Being the same property conveyed to Garry Gentry and wife, Wendy Gentry, as tenants by the entirety in Warranty Deed, as filed at Book WD283, Page 133 in the Register’s Office of Macon County.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property: 
The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.  W&A No. 302400
