Forclosure Notice- Loretta and David Taylor, Ruby and Billy Joe Taylor

FORECLOSURE NOTICE

Default having been made in the terms, conditions and payments made and provided for in the Deed of Trust dated June 27, 2000 and executed by LORETTA TAYLOR, DAVID L. TAYLOR, RUBY N.  TAYLOR and BILLY JOE TAYLOR to Walter G. Birdwell, Jr., Trustee, which is of record in Trust Deed Book 275, Page 230, Register’s Office for Macon County, Tennessee, to which reference is here made; the entire indebtedness having been declared due and payable; payment not having been made as demanded; and David Bass, having been duly appointed as Successor Trustee, by instrument of record in Record Book 10, Page 368, Register’s Office for Macon County, Tennessee, and the said David Bass having been requested to institute foreclosure proceedings by the lawful holder and owner of the indebtedness secured by the deed of trust, notice is hereby given that I, David Bass, Successor Trustee, will on WEDNESDAY, SEPTEMBER 2, 2015, at 11:00 A.M. (local time), at the Main Door of the Macon County Courthouse, Public Square, Lafayette, Tennessee, sell at public outcry, to the highest, best and last bidder for cash, free from all legal and equitable rights of redemption and all other rights of redemption statutory or otherwise, homestead, dower and all other exceptions, elective rights and marital rights of every kind, all of which are expressly waived in said deed of trust, the following described tract or parcel of land located in the Ninth (9th) Civil District of Macon County, Tennessee, bounded and described as follows, to-wit:

LYING and BEING in the 9th Civil District of Macon County, Tennessee, situated on the East side of Jimtown Road 1,046.79 feet North of the intersection of Goad Road and being approximately 3.70 miles North of Tennessee Highway 52, being described according to a survey performed by Richard D. Graves, Tennessee Registered Land Surveyor Number 1628, on the 15th day of September, 1994, in detail as follows:

BEGINNING on a half inch iron rebar found by a corner post on the East right of way of Jimtown Road, being found 15.0 feet from the center of said road, corner of Joseph Copas (D.B. 90, Page 226) and being the northwest corner of the herein described tract, thence running and  cornering with Copas for the next two calls:  South 28 degrees 54 minutes 06 seconds East 268.21 feet to a half inch iron rebar found by a corner post, thence South 75 degrees 19 minutes 15 seconds East 14.96 feet to a half inch iron rebar found in the line of Copas, corner of Tract 2 of the Oliver Day Sale, thence running and cornering with Tract 2 of the Oliver Day Sale for the next two calls;  South 19 degrees 28 minutes 31 seconds West 141.49 feet to a half inch iron rebar found, thence North 65 degrees 26 minutes 31 seconds West 225.16 feet to a half inch iron rebar set on the East right of way of Jimtown Road, being set 15.0 feet from the center of said road corner of Tract 2 of the Oliver Day Sale, thence running and cornering with the East right of way of Jimtown Road for the next three calls:  North 21 degrees 29 minutes 33 seconds East 113.96 feet, thence North 19 degrees 08 minutes 54 seconds East 127.09 feet, thence North 25 degrees 01 minutes 09 seconds East 57.73 feet to the BEGINNING, containing 1.09 acres, more or less.

BEING the same property vested in Loretta Taylor by warranty deed from Oliver Day and wife, L.E. Day, dated February 3, 1995, and recorded in Deed Book 197, Page 169, Register’s Office for Macon County, Tennessee.  By Warranty deed, Loretta Taylor conveyed a 1/3 interest to David and Ruby Taylor, dated September 19, 1997, and recorded in Deed Book 214, Page 329, Register’s Office for Macon County, Tennessee. By Warranty Deed dated June 12, 2000, Loretta Taylor conveyed a 1/3 interest to Billy Joe Taylor and recorded in Deed Book 234, Page 287, Register’s Office for Macon County, Tennessee.

The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
Said sale will be made subject to any and all taxes that may be a lien against the property and any prior deeds of trust or liens that may exist against the property.
