NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions and payments made and provided for in a Deed of Trust executed by Kerry Cothron and wife, Virginia Cothron, which Deed of Trust is of record in Trust Deed Book 432, page 47, Register’s Office of Macon County, Tennessee, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust, and payment not having been made as demanded, notice is hereby given that I, Radford A. West, Trustee, under the power and authority vested in me and having been requested so to do by the lawful owner and holder of said debt, will on Wednesday, September 9, 2015, At 10:00 a.m. at the front door of the Courthouse in Macon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described parcel of land in the 1st District of Macon County, Tennessee:
PARCEL #1: BEGINNING at a 10” hickory tree, being the northeast corner of this tract and a corner to Floyd Newberry property described in deed book 232, page 42 and in the line of Ronnie Likens property described in deed book 186 page 406; thence with Newberry south 32 degrees 30 minutes east 56.66 feet to an iron pin new; thence south 32 degrees 30 minutes east 8.34 feet to a point in Bradley Hollow Road; thence with Bradley Hollow Road south 64 degrees 31 minutes 18 seconds west 137.96 feet to a point in the branch, being a corner to Ronnie Likens property described in deed book 186 page 406; thence with Likens north 32 degrees 30 minutes west 20.00 feet to an iron pin new; thence north 32 degrees 30 minutes west 45.00 feet to an iron pin new in a fence line; thence north 64 degrees 31 minutes 18 seconds east 137.96 feet to the point of beginning containing 0.20 acres more or less. In accordance with a survey prepared by Steven Michael Holland, Tennessee Registered Land Surveyor license number 2337, dated 02/25/2003 and shown as drawing number 030115.
Being the property conveyed to Kerry Cothron from Rickey Barrett and wife, Georgia Barrett by deed dated April 2, 2007, recorded September 26, 2007 in Deed Book 285, page 411, Register’s Office, Macon County, Tennessee.
Subject to right-of-way in Deed Book 102, page 32, ROMCT.
PARCEL #2:Situated on the south side of Bradley Hollow Road, east of the intersection of Jones Street, described in detail as follows:
Beginning on a half inch iron re-bar set on the south side of Bradley Hollow Road, being set 10.5 feet from the center of said road, a corner in the line of Ronnie Likens (D.B. 186, P. 406) and being the northeast corner of the herein described tract; thence running with the line of Likens S 48 degrees 53 minutes E 37.20 feet to a point in the center of Clay Kirby (D.B. 69, P. 83) and the City of Lafayette; thence running with the City of Lafayette S. 49 degrees 10 minutes W. 98.69 feet to a point on a large rock in the center of said creek, new corner of Tony R. Whittemore; thence leaving the creek and severing the land of Tony R. Whittemore N. 26 degrees 09 minutes W. 53.39 feet to a half inch iron re-bar set on the south side of Bradley Hollow Road, being set 10 feet from the center of said road, new corner of Tony R. Whittemore; thence running with the south side of Bradley Hollow Road N. 59 degrees 40 minutes E. 81.32 feet to the beginning, containing 3,982.3 square feet more or less as surveyed by Richard D. Graves, Tennessee Registered Land Surveyor Number 1628, on the 18th date of October, 1996.
Being the same property conveyed to Kerry Cothron by deed from Rickey Barrett and wife, Georgia Barrett, dated April 2, 2007, of record in Deed Book 285, page 413, Register’s Office, Macon County, Tennessee.
Both parcels subject to rights-of-way of record in DB 314, p. 266 and DB 314, p. 284, ROMCT.
The street address of Parcel #1 described above is believed to be 823 Bradley Hollow Road, Lafayette, Tennessee, 37083, and the street address of Parcel #2 described above is believed to be 871 Bradley Hollow Road, Lafayette, Tennessee, 37083, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
If applicable, the notice requirements of T.C.A. 35-5-117 have been met.
Interested Parties: Macon Bank & Trust Company, Lafayette, Tennessee, is the holder of the note which the Deed of Trust secures.
The right is reserved to adjourn the day of the sale to another day at a time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
The property is to be sold “AS IS, WHERE IS,” without representation or warranty of any kind whatsoever, whether express or implied. Without limiting the foregoing, THIS PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
This sale will be made subject to any unpaid taxes and any liens or encumbrances which take priority as a matter of law.
A deposit of Ten (10%) percent of the purchase price will be required to be paid at the sale with the balance due within Three (3) business days.
