Successor Trustee Sale- Charles Carr

NOTICE OF SUCCESSOR TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated February 29, 2012, executed by CHARLES D. CARR, conveying certain real property therein described to JOE CARTER, Trustee for Citizens Bank of Lafayette, Tennessee.  Said Deed of Trust is of record in Trust Deed Book 495, Page 274, Register’s Office of Macon County, TN; and
WHEREAS, Citizens Bank is the true and lawful holder of the debt, has declared the entire indebtedness due and payable, has appointed the undersigned, A. RUSSELL BROWN, as Successor Trustee by instrument filed for record in the Macon County Register of Deeds, and has instructed the Successor Trustee to foreclose said Deed of Trust in accordance with its terms and provisions; and
WHEREAS, a search of the public records at the time of the initial publication revealed no lien filed by the United States or the State of Tennessee which affects the above described property;
NOW, THEREFORE, by the authority vested in me as Successor Trustee, I will on the 27th day of October, 2015, at 10:00 o’clock a.m. at the Macon County Courthouse, Public Square, Lafayette, Tennessee, sell at public auction to the highest and best bidder for cash the following described property known as Map: 054 Parcel: 14.03 (11th Civil District); to-wit;

TRACT 1: (Formerly being Tract 5 of the Bobby Hall property) Lying and being in the 11th Civil District of Macon County Tennessee, and BEGINNING at an iron pin (new) at the north margin of New Highway 52, being the southeast corner of this tract and a corner to Danny Wix; thence with the north margin of New Highway 52 North 57 degrees 52 minutes 07 seconds West 154.57 feet to a point; North 62 degrees 16 minutes 54 seconds west 41.43 feet to an iron pin (new), being a corner to tract 4 of the Bobby Hall Property; thence with tract 4 North 17 degrees 45 minutes 16 seconds East 1220.11 feet to an iron pin (new), being a corner to Tract 1 of the Bobby Hall property; thence with tract 1 south 71 degrees 08 minutes 32 seconds east 258.79 feet to an iron pin (new) in the line of Danny Wix; thence with Wix and a fence South 24 degrees 24 minutes 41 seconds West 426.93 feet to a 12″ sassafras; South 82 degrees 33 minutes 38 seconds West 11.88 feet to a post; South 18 degrees 05 minutes 12 seconds West 430.94 feet to a 10″ cedar South 18 degrees 32 minutes 09 seconds West 400.66 feet to the point of beginning containing 5.94 acres more or less. This legal description is pursuant to a survey taken by Holland Land Surveying No. 492 and dated 4/23/93.
The above 5.94 acre tract is benefited by a 15″ utility easement from Old Highway 52 crossing tract 2 and 4 of the Bobby Hall property and is described as follows:
BEGINNING at an iron pin at the south margin of Old Highway 52, being the northeast corner of tract 2 of the Bobby Hall property; thence with a line describing the east base line of a 15′ easement passing through tract 2 south 14 degrees 33 minutes 51 seconds West 948.60 feet to an iron pin (new), being a corner to tract 4; thence with tract 4 with a line describing the north baseline of this easement passing through tract 4 South 71 degrees 08 minutes 32 seconds east 189.50 feet, being the northwest corner of tract 5 and the end of this easement.
Being a portion of the property conveyed to Charles D. Carr from Patricia A. Carr, by quitclaim deed dated 7/8/96, recorded 8/20/96 in Deed Book 206, page 381, Register’s Office of Macon County, Tennessee, and also being the same property conveyed to Charles D. Carr by deed from Freddie W. Scruggs and wife, Sue N. Scruggs, dated 5/22/93 and recorded in Deed Book 187, page 95-97, ROMC, TN.

TRACT 2: (formerly being tract 4 of the Bobby Hall property) Lying and being in the 11th Civil District of Macon County Tennessee, and BEGINNING at an iron pin (new) at the north margin of New Highway 52, being the southwest corner of this tract and a corner to tract 3 of the Bobby Hall property; thence with tract 3 of the Bobby Hall property North 16 degrees 24 minutes 43 seconds East 1190.93 feet to an iron pin (new), being a corner to tract 2 of the Bobby Hall property; thence with tract 2 south 71 degrees 08 minutes 32 seconds East 30.50 feet to an iron pin (new), being a corner to tract 1 of the Bobby Hall property; thence with tract 1 south 71 degrees 08 minutes 32 seconds East 189.50 feet to an iron pin (new) being a corner to Tract 5 of the Bobby Hall property; thence with tract 5 South 17 degrees 45 minutes 16 seconds West 1220.11 feet to an iron pin (new) at the north margin of New Highway 52; thence with the north margin of New Highway 52 North 62 degrees 16 minutes 54 seconds West 195.00 feet to the point of beginning containing 5.69 acres more or less. This legal description is pursuant to a survey taken by Holland Land Surveying No. 492 and dated 4/23/93.
The above 5.69 acre tract is benefited by a 15′ utility easement from Old Highway 52 crossing tract 2 of the Bobby Hall property and is described as follows:

Being a portion of the property conveyed to Charles D. Carr from Patricia A. Carr, by quitclaim deed dated 7/8/96, recorded 8/20/96 in Deed Book 206, page 381, Register’s Office of Macon County, Tennessee, and also being the same property conveyed to Charles D. Carr by deed from Bobby Hall and wife, Rebecca Hall, dated 4/29/93 and recorded in Deed Book 187, page 92-94, ROMC, TN.

TRACT 3: (formerly being tract 3 of the Bobby Hall property) Lying and being in the 11th Civil District of Macon County Tennessee, being tract 3 of the Bobby Hall property and BEGINNING at an iron pin (new) at the north margin of New Highway 52, being the southwest corner of this tract and a corner to J.D. Sanders; thence with Sanders North 15 degrees 31 minutes 59 seconds East 400.04 feet to a 24″ maple; North 15 degrees 13 minutes 29 seconds East 357.29 feet to a post; North 15 degrees 26 minutes 02 seconds East 395.00 feet to an iron pin (new), being a corner to tract 2 of the Bobby Hall property; thence with tract 2 of the Bobby Hall property south 71 degrees 08 minutes 32 seconds east 210.00 feet to an iron pin (new), being a corner to tract 4 of the Bobby Hall property; thence with tract 4 south 16 degrees 24 minutes 43 seconds west 1190.93 feet to an iron pin (new) at the north margin of New Highway 52; thence with the north margin of New Highway 52 north 62 degrees 16 minutes 54 seconds west 114.46 feet to a point; North 55 degrees 27 minutes 59 seconds West 81.32 feet to the point of beginning containing 5.37 acres more or less. This legal description is pursuant to a survey taken by Holland Land Surveying No. 492 and dated 4/23/93.
The above 5.37 acre tract is benefited by a 15′ utility easement from Old Highway 52 crossing tract 2 and 4 of the Bobby Hall property and is described as follows:
BEGINNING at an iron pin at the south margin of Old Highway 52, being the northeast corner of tract 2 of the Bobby hall property; thence with a line describing the east base line of a 15′ easement passing through tract 2 south 14 degrees 33 minutes 51 seconds West 948.60 feet to an iron pin (new), being a corner to tract 4; thence with tract 4 with. a line describing the north baseline of this easement passing through tract 4 North 71 degrees 08 minutes 32 seconds west 30.50 feet, being the northeast corner of tract 3 and the end of this easement.
Being a portion of the property conveyed to Charles D. Carr from Patricia A. Carr, by quitclaim deed dated 7/8/96, recorded 8/20/96 in Deed Book 206, page 381, Register’s Office of Macon County, Tennessee, and also being the same property conveyed to Charles D. Carr by deed from Bobby Hall and wife, Rebecca Hall, dated 4/29/93 and recorded in Deed Book 187, page 16, ROMC, TN.

Physical address of this property is thought to be 11026 Highway 52 West, Westmoreland (Macon County), TN.  However, this property is being sold  pursuant to the legal descriptions and reliance on the physical address should not  be made.
Said sale shall be to the highest bidder for cash in bar of all rights and equities of redemption, statutory or otherwise, homestead, dower, and all other rights or exemptions of every kind, all of which are expressly waived in said Deed of Trust. The title is believed to be good, but the undersigned will convey and sell only as Successor Trustee.  The property is sold as is, where is, without representations or warranties of any kind, including fitness for a particular use or purpose.  Said sale is subject to all matters shown on any recorded plat, any unpaid taxes, easements, covenants, any prior or superior liens or encumbrances, and to any matter that an accurate survey might disclose.  This sale is also subject to the rights of any person in possession.

If a high bidder fails to close a sale, the Successor Trustee shall have the option of making the sale to the next highest bidder who is able, capable, and willing to comply with the terms thereof.  The right is reserved to adjourn the sale to another day, place or time certain, without further publication, upon announcement of same at the time of adjournment.
