NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions and payments made and provided for in a Deed of Trust executed by Kerry Cothron and wife, Virginia Cothron, which Deed of Trust is of record in Trust Deed Book 442, page 357, Register’s Office of Macon County, Tennessee, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust, and payment not having been made as demanded, notice is hereby given that I, Radford A. West, Trustee, under the power and authority vested in me and having been requested so to do by the lawful owner and holder of said debt, will on Friday, December 4, 2015, At 10:00 a.m. at the front door of the Courthouse in Macon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described parcel of land in the 1st District of Macon County, Tennessee:
Lying and being in the 1st Civil District of Macon County, Tennessee, and being Lot #13 of Fox Run Subdivision, Part 5, of record in Plat Cabinet 1, Slide 174-A, Register’s Office of Macon County, Tennessee. Surveyed by Holland Land Surveying, 606 Red Boiling Springs Road, Lafayette, TN License #492, dated 1/13/98.
Being the same property conveyed to Kerry Cothron and wife, Virginia Cothron, by Warranty Deed from Steven D. Napier and wife, Charlotte K. Napier, dated May 9, 2008, of record in Deed Book 289, page 265, Register’s Office, Macon County, Tennessee. Kerry Cothron died on February 28, 2012, leaving the above property vested in Virginia Cothron.
The street address of the property described above is believed to be 410 Deer Park Lane, Lafayette, Tennessee, 37083, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
If applicable, the notice requirements of T.C.A. 35-5-117 have been met.
Interested Parties: Macon Bank & Trust Company, Lafayette, Tennessee, is the holder of the note which the Deed of Trust secures. Citizens Bank, Carthage, Tennessee, is the holder of a second Deed of Trust secured by the above property. Noel Smith, Hartsville, Tennessee, is the holder of a Judgment Lien against the Estate of Kerry Ronald Cothron.
The right is reserved to adjourn the day of the sale to another day at a time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
The property is to be sold “AS IS, WHERE IS,” without representation or warranty of any kind whatsoever, whether express or implied. Without limiting the foregoing, THIS PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
This sale will be made subject to any unpaid taxes and any liens or encumbrances which take priority as a matter of law.
A deposit of Ten (10%) percent of the purchase price will be required to be paid at the sale with the balance due within Three (3) business days.
