NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated June 28, 2006, and the Deed of Trust of even date securing the same, recorded July 5, 2006, in Book No. TD402, at Page 451,   in Office of the Register of Deeds for Macon County, Tennessee, executed by Barry White and Jacquelyn White, conveying certain property therein described to Benchmark Title Company as Trustee for Mortgage Electronic Registration Systems, Inc., as a nominee for Ownit Mortgage Solutions, Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by U.S. Bank National Association, as Trustee, Successor in interest to Bank of America, National Association, as Trustee, Successor by Merger to LaSalle Bank National Association, as Trustee for Merrill Lynch Mortgage Investors Trust, Mortgage Loan Asset-Backed Certificates, Series 2007-SD1.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by U.S. Bank National Association, as Trustee, Successor in interest to Bank of America, National Association, as Trustee, Successor by Merger to LaSalle Bank National Association, as Trustee for Merrill Lynch Mortgage Investors Trust, Mortgage Loan Asset-Backed Certificates, Series 2007-SD1, will, on January 5, 2016 on or about 12:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:

Lying and being in the 1st Civil District of Macon County, Tennessee, and being a part of Lot No. 36 of the West End addition to the City of Lafayette, Tennessee, a plat of which is of record in Deed Book No. 51, Page No. 376, Register’s Office, Macon County, Tennessee, reference to which is here had for the purpose of location; starting on a steel pin in the west T.W. of Painter Drive, said pin being the S.E. corner of property of Jack Burrow, running thence with the said W. R. W. of Painter Drive S. 1/2 degrees W. 139 feet 4 inches to a steel pin; thence A.R. 89 degrees 5 minutes 233 feet to a steel pin in the James H. White line; thence N. 2 degrees E. 156 feet 8 inches with the James White line to a steel pin, a corner of Jack Burrow; thence S. 86-1/2 degrees E. 225 feet 7 inches to the beginning, with a closing inclusive angle of 93 degrees 12′, containing .78 acre, more or less.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.  W&A No. 309261
