Trustee Sale – Benjamin & Kara Gentry


WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated October 17, 2014, and the Deed of Trust of even date securing the same, recorded October 20, 2014, in Book No. TD532, at Page 329,   in Office of the Register of Deeds for Macon County, Tennessee, executed by Benjamin T. Gentry and Kara Gentry, conveying certain property therein described to David W. Kious as Trustee for Mortgage Electronic Registration Systems, Inc., as a nominee for Guaranty Trust Company, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Guaranty Trust Company.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Guaranty Trust Company, will, on March 17, 2016 on or about 12:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
WHITE ESTATE TRACT #4     5.01 acres: Being located in the 1 st  Civil District of Macon County, Tennessee and more particularly described as follows: Beginning at an iron rod in the southwest margin of Coleytown Road, same being the northwest corner of this tract and the northeast corner of Tract #3 of the White Estes Property (31.54 acres as per survey of same date), also being 253.94 feet southeast of the easternmost corner of Kenny L. Davis as you measure along said margin; thence with said margin along a curve proceeding clockwise, having a deflection angle of 00 deg. 46 min. 35 sec. a radius of 5825.00 feet, a tangent length of 39.47 feet and a chord of South 43 deg. 18 min. 57 sec. East 78.94 feet; thence along said curve an arc length of 78.94 feet to an iron rod in said margin; thence leaving road with line of Tract #5 of the White Estate property (5.01 acres as per survey of same date) South 12 deg. 34 min. 27 sec. West 993.89 feet to an iron rod; thence with line of said Tract #3 North 82 deg. 14 min. 32 sec. West 207.91 feet to an iron rod; thence North 07 deg. 15 min. 46 sec. East 649.88 feet to an iron rod; thence North 38 deg. 52 min. 57 sec. East 455.72 feet to the point of beginning, containing 5.01 acres more or less by survey by Carroll Dean Carman, Registered Land Surveyor, Tennessee No. 910, address 150 Middle Fork Road, Hartsville, Tennessee, 37074, dated September 25, 2003.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:
