NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated May 20, 2002, and the Deed of Trust of even date securing the same, recorded May 29, 2002, in Book No. TD308, at Page 404 and re-recorded on March 8, 2004, in Book No. TD350, at Page 88,   in Office of the Register of Deeds for Macon County, Tennessee, executed by Mark E. Heatherly and Angela P. Heatherly, conveying certain property therein described to Denise Haraseviat as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Washington Mutual Bank, FA, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wells Fargo Bank, N.A..
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wells Fargo Bank, N.A., will, on May 10, 2016 on or about 12:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Land located in the 6th Civil District of Macon County, Tennessee, being described as follows, to wit:  Beginning at an iron pin (new) in the line of Stitches property described in Deed Book 146, Page 361, being the Northeast corner of this tract and South 21 degrees 28 minutes 44 seconds West 322.28 feet from a corner fence post at the South margin of Pickett Road; thence with Stitches South 17 degrees 25 minutes 45 seconds West 399.37 feet to an iron pin (new) by a post; thence North 62 degrees 36 minutes 46 seconds West 107.47 feet to an iron pin (new) by an iron post, being a corner to the remaining property of Johnny and Willodean Howard; thence with line severing the property of Howard, North 14 degrees 39 minutes 37 seconds East 327.10 feet to a point at the end of a 20 foot ingress and egress easement to Pickett Road; thence North 14 degrees 39 minutes 37 seconds East 76.42 feet to an iron pin (new) by a 16 inch oak; South 62 degrees 29 minutes 59 seconds East 127.31 feet to the point of beginning containing 1.06 acres, more or less.
Easement: The above described 1.06 acre tract is benefited by a 20 foot ingress and egress easement through the remaining property of Johnny and Willodean Howard property described in Deed Book 74, page 601 and the easement is described as follows: Beginning in a post at the south margin of Pickett Road, being the northwest corner of this easement and a corner to David Burton property described in deed book 117, page 263; thence with David Burton and a line describing the west baseline of a 20 foot easement south 15 degrees 14 minutes 10 seconds east 157.90 feet to a point at the west boundary of the 1.06 acre tract. Being the same property conveyed to Grantee in Warranty Deed, as filed at in the Register’s Office of Macon County.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.  W&A No. 83798
