Notice of Trustee’s Sale – Tonya & Jason Bean

NOTICE OF TRUSTEE’S SALE

Default having been made in the terms, conditions and payments made and provided for in a Deed of Trust executed by Tonya G. Bean and husband, Jason B. Bean, to Macon Bank & Trust Company, Red Boiling Springs, Tennessee, on November 18, 2005, which Deed of Trust is of record in Trust Deed Book 390, page 169, Register’s Office of Macon County, Tennessee, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust, and payment not having been made as demanded, notice is hereby given that George Allen Melton, Jr., Trustee, under the power and authority vested in him and having been requested so to do by the lawful owner and holder of said debt, will on Thursday, November 17, 2016, At 11:00 a.m. at the South door of the Courthouse on the Public Square in Macon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described parcel of land in the 6th District of Macon County, Tennessee:
BEGINNING on a iron pin (old) in the north margin of West Road, said pin being Robin Deckard’s (255-331) south west corner; thence with the north margin of West Road S86º34’06”W 493.13’ to a wood post in a fence line, being a corner of Stitches Incorporated %Alfred Turner (146-361); thence leaving West Road and with the east line of Stitches Incorporated % Alfred Turner N3º11’ 14”E 66.42’ to a 24” oak in a fence line; thence N41º12’56”E 79.37’ to a 28” oak in  a fence line; thence N39º01’22”E 144.56’ to a wood post in a fence line; thence N34º52’43”E 123.74’ to a dead snag in a fence line; thence N37º35’16”E 239.47’ to a 14” elm in a fence line; thence N18º23’37”E 21.19’ to a 6” hickory in a fence; thence N07º24’11”W 34.67’ to a wood post in a fence line, being Judith and James Craighead’s (151-361) south west corner; thence with the south line of Judith and James Craighead S81º21’17”E 41.52’ to a 10” pin oak in a fence line, being Robin Deckard’s (255-331) north west corner; thence leaving Judith and James  Craighead and with the west line of Robin Deckard S05º46’09”E 541.58’ to the point of beginning.  Containing 3.14 acres, more or less, as surveyed by Alfred M. Bartlett R.L.S. #762on October 28, 2005.
Being the same property conveyed to Tonya Bean and husband, Jason Bean, by deed from Wayne Birdwell and wife, Gail Birdwell dated November 8, 2005, and recorded in Deed Book 272, Page 272, and from Jason Bean to Tonya Bean by Quitclaim Deed dated October 2, 2007, of record in Deed Book 286 page 10, Register’s Office, Macon County, Tennessee.
Also being conveyed is a 2005 Modular One Belle Meade double-wide Mobile Home.  Address of Property:   1059 West Road, Red Boiling Springs, Tennessee
Interested Parties:    Macon Bank & Trust Company, Red Boiling Springs, Tennessee, is the holder of the note which the Deed of Trust secures. 
If applicable, the notice requirements of T.C.A. 35-5-117 have been met.
The right is reserved to adjourn the day of the sale to another day at a time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
The property is to be sold “AS IS, WHERE IS,” without representation or warranty of any kind whatsoever, whether express or implied.  Without limiting the foregoing, THIS PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
This sale will be made subject to all unpaid taxes and any liens or encumbrances which take priority as a matter of law.
A deposit of Ten (10%) percent of the purchase price will be required to be paid at the sale with the balance to be paid within three (3) days.
