NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions and payments made and provided for in a Deed of Trust executed by Ennis McGuffie and wife, Evelyn McGuffie, to James W. Chamberlain, Trutee for Othell Russell, on October 16, 2007, of record in Trust Deed Book 432, page 67, and assigned to Betty Sanders, et al, on March 26, 2012, of record in Trust Deed Book 497, page 290, Register’s Office of Macon County, Tennessee, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust and assignment, and payment not having been made as demanded, notice is hereby given that Christi L. Dalton, Substitute Trustee, under the power and authority vested in her by Appointment of Substitute Trustee of record in Trust Deed Book 497, page 284, Register’s Office, Macon County, Tennessee, and having been requested so to do by the lawful owner and holder of said debt, will on Thursday, February 2, 2016, At 11:00 a.m. at the South door of the Courthouse on the Public Square in Macon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described parcel of land in the 1st District of Macon County, Tennessee:
Being Lot 1 of the Ruby Thomas Subdivision, a plat of which is of record in Plat Cabinet C-2, Slide 111-B, Register’s Office, Macon County, Tennessee, according to a survey dated April 29, 2003, by Steven M. Holland, Registered Land Surveyor #2337, Holland Land Surveying, 275 Hunt Lane, Lafayette, Tennessee, 37083.
Being the same property conveyed to Ennis McGuffie and wife, Evelyn McGuffie, by trustee’s deed from James W. Chamberlain, Trustee, dated October 16, 2007, and recorded in Deed Book 286, Page 66, Register’s Office, Macon County, Tennessee.
Subject to Restrictions of record in Deed Book 286, page 66, Register’s Office, Macon County, Tennessee.
Address of Property: 432 Spring Creek Road, Lafayette, Tennessee
Interested Parties: Betty Sanders, et al, 1824 Remington Place, Indianapolis, Indiana, is the holder of the note which the Deed of Trust secures.
If applicable, the notice requirements of T.C.A. 35-5-117 have been met.
The right is reserved to adjourn the day of the sale to another day at a time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
