NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated October 27, 2011, and the Deed of Trust of even date securing the same, recorded October 31, 2011, in Book No. TD490, at Page 316, in Office of the Register of Deeds for Macon County, Tennessee, executed by Charles J Harpring and Judi Gottier-Harpring, conveying certain property therein described to Hugh M. Queener as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Pinnacle National Bank, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wells Fargo Bank, N.A..
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wells Fargo Bank, N.A., will, on April 5, 2017 on or about 10:00 AM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Lying and being in the 6th Civil District of Macon County, Tennessee, and beginning on a point in the center of the Gravel Road marked by a post on the south side and a corner to Pharris; thence with Pharris S 35 degrees 59′ W 795.6 ft. to an iron pin in Pharris line, corner to Tract 2; thence with Tract 2 N 19 degrees 55′ W 536.6 ft. to an iron pin; thence N 61 degrees 33′ E 675.6 ft. to a point in the center of the road marked by an iron pin on the south side of road; thence with said road S 17 degrees 08′ E 191.0 ft. to the beginning, containing 5.50 acres more or less. The above-described property is subject to a water line easement in favor of Mattie Sue Frost, her heirs and assigns. Said easement includes the right to install, repair, maintain, alter, and operate a water line in, over, across, and under a strip of land not to exceed 15 feet in width along the current water line.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
