NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated December 7, 2011, and the Deed of Trust of even date securing the same, recorded December 9, 2011, in Book No. TD492, at Page 90, in Office of the Register of Deeds for Macon County, Tennessee, executed by Jacob R Jordan and Katrina K Jordan, conveying certain property therein described to David L. Flitcroft as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Citizens Bank of Lafayette, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Branch Banking & Trust Company.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Branch Banking & Trust Company, will, on February 13, 2018 on or about 10:00 AM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Lying in the 1st Civil District of Macon County, Tennessee, and being more particularly described as follows: Tract No. 7: Beginning on an iron pin in the north margin of Johns Creek Road and a corner to Sarah McClard running with the north margin of Johns Creek Road N 70° 27’18” W 80.31′, thence N 59° degrees 01’45” W 240.20′, thence N 54° 24′ 19” W 115.50′ to an iron pin, a corner to Tract No. 8, thence with Trace No. 8 N 10° 47′ 45” E 295.20′ to an iron pin, thence N 10° 47′ 47″ E 537.50′ to a rock, a corner to Sarah McClard, thence with Sarah McClard S 10°07′ 54” W 574.34′ to a twin hackberry S 08° 21′ 11” W 247.68′ to an iron pin at 30” beech S 31° 28′ 46” E 205.37′ to the beginning. Tract No. 8: Beginning on an iron pin in the north margin of the Johns Creek Road and a corner to Tract NO. 7 being Tract NO. 8 southeast corner and Tract NO. 7 southwest corner, thence running with the north margin of Johns Creek Road, N 54° 29′ 20′ W 151.70′ to an iron pin, a corner to Tract No. 9, thence with Tract No. 9, N 35° 43′ 23” E 79.0′ to an iron pin, thence N 21° 10′ 05” W 350.0′ to an iron pin, thence N 35° 05′ 10” W 405.52′ to an iron pin a corner to R.C. East, thence N 87° 10′ 33” E 287.68′ to a 20” maple, thence S 86° 55′ 30″ E 259.19′ to a rock a corner to Tract No. 7 and Sarah McClard, thence with Tract No. 7 S 10° 47′ 45” W 537.50′ to an iron pin, thence S 10° 47′ 45” W 295.20′ to the beginning. Included with this description is a 20.0′ wide egress and ingress and utility easement from the iron pin in the line to Tract No. 7 to the beginning, iron pin of Tract No. 7. This easement crosses Tract No. 7.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
