Notice of Trustee Sale – Daniel Claywell & Jamie Powell

NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions and payments made and provided for in a Deed of Trust executed by Daniel B. Claywell and Jamie Powell, to Macon Bank & Trust Co., Lafayette, Tennessee, on March 16, 2009, which Deed of Trust is of record in Trust Deed Book 455, page 428, Register’s Office of Macon County, Tennessee, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust, and payment not having been made as demanded, notice is hereby given that Radford West, Trustee, under the power and authority vested in him by said Deed of Trust, and having been requested so to do by the lawful owner and holder of said debt, will on Friday, February 23, 2018, At 10:15 a.m. at the front door of the Courthouse in Macon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described parcel of land in the 9th District of Macon County, Tennessee:
TRACT NO. 1: Beginning on a beech tree in the hollow near Salt Lick Creek; thence Northward to an oak stump, corner to Wilson and Homer Brandon; thence with Brandon’s line Southwestward close to Wilson’s and McDonald’s corner in Brandon’s line; thence with McDonald’s line to the beginning, containing about 6 acres more or less.
TRACT NO. 2: Beginning on a stone in the place of a double sugartree; thence N. 36 poles to a sycamore; thence N. 70½ East 56¼ poles to a stake; thence N. 11 W. 62 poles to a stake in the Creek; thence N. 80 W. 5 poles to a sycamore; thence S. 31 W. 44 P. to the beginning by estimation 15 ½ acres more or less. Bounded as follows: On the South by Garfield Wilson; on the North by the top of the bluff on the East by E.J. McDonald. Being the same property conveyed to Daniel B. Claywell and Jamie Powell by deed from Daniel B. Claywell, dated March 16, 2009, of record in Deed Book 294, page 215, Register’s Office, Macon County, Tennessee.

Interested Parties:Macon Bank & Trust Co, Lafayette, Tennessee, is the holder of the note which the Deed of Trust secures.
Midland Funding, LLC is the holder of a Judgment Lien. Tennessee Farmers Mutual Insurance Co., is the holder of a Judgment Lien.
If applicable, the notice requirements of T.C.A. 35-5-117 have been met.
The right is reserved to adjourn the day of the sale to another day at a time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.
The property is to be sold “AS IS, WHERE IS,” without representation or warranty of any kind whatsoever, whether express or implied. Without limiting the foregoing, THIS PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
This sale will be made subject to any unpaid taxes and any liens or encumbrances which take priority as a matter of law.
A deposit of Ten (10%) percent of the purchase price will be required to be paid at the sale with the balance to be paid within three (3) days.
