Notice of Trustee’s Sale- Kyle Cates

NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions, and payments provided in a certain Deed of Trust dated September 25, 2015, executed by Kyle D. Cates, of record in Record Book 12, Page 366, Register’s Office of Macon County, Tennessee, to secure the indebtedness described therein to THE FARMERS BANK, the entire indebtedness having been declared due and payable as provided in said Deed of Trust, Oldham & Dunning, LLC, Trustee, will by virtue of the power and authority vested in it, on November 14, 2018, at on or about 10:00 a.m. at the historic Macon County Courthouse, located on the Public Square in Lafayette, Tennessee, will sell said property to the highest bidder, for cash at public outcry, free from the equity of redemption, statutory right of redemption, homestead, dower, surviving spouses’ rights and all other exemptions of every kind, which are hereby expressly waived, and subject to any unpaid property taxes and assessments, and subject to all prior liens of record, if any, the following described property situated in Macon County, Tennessee, to-wit:
PARCEL NO. 1: Lying and being in the 1st Civil District of Macon County, Tennessee and being Lot No. 4-C to the Ragland No. 1 Addition to the City of Lafayette, Tennessee, a plat of which is of record in Plat Book 1, page 16, now Plat Cabinet 1, Slide 110 A & B, Register’s Office of Macon County, Tennessee.
PARCEL NO. 2: Lot No. 5B: Being located in the 1st Civil District of Macon County, Tennessee, on the northwest side of Parkview Street and being shown on a plat Resubdivision of Lot 5 Block C of Ragland Addition No. 1 of record in Plat Cabinet 4, Slide 88-a, Register’s Office of Macon County, Tennessee. Being the property conveyed to Kyle Cates by deed of Record Book 12, Page 364, Register’s Office of Macon County, Tennessee.
Shown as Map/Parcel 50JB-10.00, Tax Assessor’s Office of Macon County, Tennessee.
Property Address: 100 Parkview Street, Lafayette, TN 37083. In the event of any discrepancy between the property address and the legal description, the legal description shall control.
ALSO INCLUDED IN THIS SALE IS ALL RESTAURANT EQUIPMENT LOCATED ON THE PROPERTY.
This sale is subject to all matters shown on any applicable recorded Plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances, as well as any priority created by a fixture filing; and subject to any matter that an accurate survey of the premises might disclose. The above-described property will be sold “as is” with no warranties, express or implied, including but not limited to any warranties as to the condition of the property or its fitness for any particular purpose.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Trustee, be cause for rejection of the bid, and, if the bid is rejected, the Trustee shall have the option of making the sale to the next highest bidder who is ready, willing and able to comply with the terms thereof.
The proceeds derived from the sale of the property will be applied as provided for in said deed of trust. Said deed of trust is made a part hereof as if copied verbatim herein.
