NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated December 15, 2017, and the Deed of Trust of even date securing the same, recorded December 20, 2017, in Book No. RB50, at Page 571, in Office of the Register of Deeds for Macon County, Tennessee, executed by Donald C Tapper and Melissa Marie Tapper, conveying certain property therein described to Smith Scholar Milliken as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for InterLinc Mortgage Services, LLC, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by AmeriHome Mortgage Company, LLC.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by AmeriHome Mortgage Company, LLC, will, on February 19, 2019 on or about 1:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
A certain tract or parcel of land in the 8th Civil District of Macon County , Tennessee, is further described as follows, to wit: Beginning at an iron rod in the Southeast margin of Peyton’s Creek Road, same being the Northwest corner of this tract and the Northern most corner of Steven Paxson; thence with said margin along a curve proceeding clockwise, having a deflection angle of 17 degrees 26 minutes 01 second a radius of 185.60 feet, a tangent length of 28.46 feet, and a chord of North 48 degrees 25 minutes 38 seconds East 56.26 feet; thence along said curve an arc length of 56.47 feel; thence North 57 degrees 08 minutes 38 seconds East 438.00 feet to a point; same being point of curvature of a curve proceeding clockwise, having a deflection angle of 17 degrees 45 minutes 17 seconds, a radius of 486.00 feet, a tangent length of 75.91 feet and a chord of North 66 degrees 01 minute 17 seconds East 150.00 feet; thence along said curve an at length of 150.60 feet; thence North 74 degrees 53 minutes 55 seconds East 96.70 feet to a point; the same being point of curvature of a curve proceeding counter-clockwise, having a deflective angle of 17 degrees 07 minutes 24 seconds, a radius of 207.00 feet, a tangent length of 31.16 feet and a chord of North 66 degrees 20 minutes 13 seconds East 61.63 feet; thence along said curve an arc length of 61.86 feet to an iron rod in said margin; thence leaving road with line of said Tract Number 1 of the Ferrara property South 32 degrees 13 minutes 29 seconds East 722.52 feet to an iron rod; thence with line of Clyde Gregory South 61 degrees 21 minutes 05 seconds West 240.00 feet to an iron rod at a 16 inch locust tree; thence South 57 degrees 06 minutes 29 seconds West 166.61 feet to an iron rod at a 22 inch
sycamore tree; thence South 64 degrees 06 minutes 01 second West 87.47 feet to an iron rod at a large mulberry tree; thence North 62 degrees 26 minutes 59 seconds West 103.62 feet to an iron rod at a 10 inch walnut tree; thence North 63 degrees 54 minutes 21 seconds West 163.52 feet to an iron rod at a double ash tree; thence North 51 degrees 28 minutes 08 seconds West 200.00 feet to an iron rod; thence South 5 degrees 29 minutes 24 seconds West 173.17 feet to an iron rod at a 14 inch elm tree; thence with line of Gary Ferrara North 84 degrees 36 minutes 12 seconds West 197.78 feet to an iron rod; thence with the line of Steve Paxson North 17 degrees 43 minutes 18 seconds East 141.18 feet to an iron rod at a double ash tree; thence North 23 degrees 18 minutes 58 seconds East 125.71 feet to an iron rod at a 16 inch cherry tree; thence North 46 degrees 50 minutes 05 seconds West 187.89 feet to the point of beginning. Survey by Carroll Dean Carman, Registered Land Surveyor, Tennessee Number 910, address 150 Middle Fork Road, Hartsville, TN 370704, dated April 28, 1997. INCLUDED in the above described legal description is a parcel of land conveyed to Mary A. Cross, by deed of record in Deed Book 230, Pages 123-124, in the Register’s Office for Macon County, Tennessee, described as follows: Beginning on an iron pin in the south margin of Peyton’s Creek Road 12.0 feet from the North West Corner of the mentioned deed above, running with the South Margin of Peyton Creek Road North 48-25-38 East 44.26 feet, thence North 57-08-38 East 190.0 feet to an iron pin; thence the next two calls with the said mentioned deed South 47-05-11 East 189.47, South 55-50-00 West 235.0 feet to an iron pin 12.0 feet from the Cherry Tree mentioned in the Deed above; thence a line 12.0 feet from the West Boundary and parallel with the same North 46-50-05 West 187.89 feet to the beginning, containing 1.0 acres more or less.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed for a period of two weeks. In such situations, notices will be mailed to interested parties of record.
