NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated April 7, 2003, and the Deed of Trust of even date securing the same, recorded April 9, 2003, in Book No. TD326, at Page 185, and modified on July 31, 2017, In Book No. Rb43, At Page 458 in Office of the Register of Deeds for Macon County, Tennessee, executed by Heather E. Troutt and Margaret E. Troutt, and subsequently assumed by John Liles; conveying certain property therein described to Tonya Esquibel as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for CTX Mortgage Company, LLC, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by MidFirst Bank.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by MidFirst Bank, will, on March 4, 2019 on or about 1:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
BEGINNING on a 1/2″ iron re-bar found by a corner post at the southeast corner of Stephen D. Hibner (Deed Book 142, Page 96) in the line of J.D. Sanders (Deed Book 55, Page 440) being the northeast corner of the herein described tract; thence running with the line of J.D. Sanders (Deed Book 55, Page 44) S 7° 13′ 28″ W 723.81′ to a 1/2 inch iron re-bar set in a fence in the line of J.D. Sanders (Deed Book 55, Page 440) at a new corner of Kay Troutt (Deed Book 169, Page 333 -remainder) thence severing the lands of Kay Troutt running and cornering with new lines for the next six calls: N 79° 43′ 45″ W 134.71′ (passing through a 1/2 inch iron re-bar set at 104.69 feet at the northeast corner of the 30.0 foot access easement or extension of Curtis Lane to connect this tract with Old Highway 52) to a 1/2 inch iron re-bar set at the northwest end of the aforesaid referenced 30.0 foot access easement; thence N 22° 24′ 54″ E 58.62′ to a 1/2″ iron re-bar set; thence N 4° 48′ 49″ W 44.09′ to a 1/2″ iron re-bar set; thence N 49° 50′ 30″ W 47.66′ to a 1/2″ iron re-bar set; thence N 79° 43′ 45″ W 61.41′ to a 1/2″ iron re-bar set; thence N 7° 13′ 28″ E 600.00′ to a 1/2″ iron re-bar set in a fence in the line of Stephen D. Hibner (Deed Book 142, Page 96) being located further S 79° 43′ 45″ E 342.17′ from a car axle found in the line of Roger Hammock (Deed Book 173, Page 255) at a corner of William J. Anderson (Deed Book 131, Page 74); thence running with Stephen D. Hibner (Deed Book 142, Page 96) S 79° 43′ 45″ E 230.00 feet to the beginning. ACCESS to the above described tract is provided by a 30.00 foot access easement over and including Curtis Lane and severing the lands of Kay
Troutt (Deed Book 169, Page 333 -remainder) being described in detail as follows: BEGINNING on a point on the north right of way of Old Highway 52, being 25.0 feet from the center of said highway and located further S 87° 34′ 25″ W 51.22′ from a 1/2″ iron re-bar found on the north right of way of the aforesaid highway at the southwest corner of James T. Overton (Deed Book 164, Page 386); thence running with the north right of way of Old Highway 52 S 87° 34′ 25″ W 30.29′ to a point on the north right of way of the highway, being 25.0′ from the center of said highway; thence severing the lands of Kay Troutt (Deed Book 169, Page 333 -remainder) and running and cornering in part with Curtis Lane along new lines for the next seven calls: N 5° 31′ 49″ E 42.29′ to a point; thence N 21° 00′ 08″ E 70.52′ to a point; thence N 24° 48′ 06 E 95.79′ to a point; thence N 21° 02′ 52″ E 40.15′ to a point; thence N 16° 25′ 37″ E 63.91′ to a point; thence N 9° 41′ 14″ E 314.68′ to a point; thence N 8° 05′ 19″ E 458.89′ to a 1/2″ iron re-bar set at the southwest corner of the above described tract at the northwest end of this 30.0 feet access easement or extension of Curtis Lane; thence running with the southern line of the above described tract S 79° 43′ 45″ E 30.02′ to a 1/2″ iron re-bar set on the southern line of the above described tract at the northeast end of this 30.0 foot access easement or extension of Curtis Lane; thence severing the lands of Kay Troutt (Deed Book 169, Page 333 -remainder) and running and cornering in part with Curtis Lane along new lines for the next seven calls: S 8° 05′ 19″ W 458.21′ to a point; thence S 9° 41′ 14″ W 316.82′ to a point; thence S 16° 25′ 37″ W 66.88′ to a point; thence S 21° 02′ 52″ W 42.34′ to a point; thence S 24° 48′ 06″ W 95.78′ to a point; thence S 21° 00′ 08″ W 65.45 ‘ to a point; thence S 5° 31′ 49″ W 34.03’ to the beginning for ingress and egress to connect to the above described tract with Old Highway 52. Grantee will be responsible for said maintenance.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set
