NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated May 16, 2012, and the Deed of Trust of even date securing the same, recorded May 21, 2012, in Book No. TD498, at Page 219, in Office of the Register of Deeds for Macon County, Tennessee, executed by Larry Dallas and Heather Dallas, conveying certain property therein described to Joe Carter as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Citizens Bank of Lafayette, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by PNC Bank, National Association.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by PNC Bank, National Association, will, on February 19, 2019 on or about 1:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Lying and being in the 11th Civil District of Macon County, Tennnessee; situated on the north side of New State Route 52 in the Siloam Community, being described as follows: Beginning on a 3/8 inch re-bar set on the north right of way of New Tennessee Highway 52 in the line of Clinton Yor (DB 143, Page 265), being the southwest corner of the herein described tract, thence; running with the north right of way of New Tennessee Highway 52 S. 74 deg. 50 min. E. 244.00 feet to a 3/8 inch re-bar set in the center of a gulley on the north right of way of New Tennessee Highway 52, new corner of Gladys C. Lambert (DB 124 Page 372 P/O Tract 2 Southwest corner of a 4.03 acre tract of Lambert’s); thence running and cornering with Lambert along new lines for the next four calls: running in the center of the gulley N. 2 deg. 31 min. E. 47.60 feet to a 3/8 inch re-bar set in a hole in the rock; thence running in the center of the gulley N. 11 deg. 31 min. E. 49.55 feet to an electric fence post set in the gulley; thence leaving the gulley N. 62 deg. 24 min. E. 69.70 feet to an electric fence post set; thence N. 21 deg. 55 min. E. 148.00 feet to a point in the center of a branch marked by an electric fence post set in the line at 136.00 feet on the south bank, being a corner of Lambert (northwest corner of the 4.03 acre tract and a corner to the remaining lands of Lambert); thence running with Lambert and Leonard Day (DB 86 Page 225) and Larry Harper (DB 177 Page 263) in the center of the branch N. 48 deg. 32 min. W. 82.30 feet to a corner of Harper; thence running with Harper in the center of the branch S. 83 deg. 28 min. W. 69.00 feet to a point in the center of the branch at a corner of Harper and Benton Veatch (DB 89 Page 132); thence running and cornering with Veatch in the center of the branch for the next two calls: N 88 deg. 32 min. W. 71.80 feet to a point in the center of the branch; thence S. 74 deg. 38 min. W. 67.90 feet to a point in the center of the branch at the corner of Veatch and Thomas Burns (DB 97 Page 103); thence running with Burns in the center of the branch S. 81 deg. 17 min. W. 56.50 feet to a point in the center of the branch at a turn at a corner of Burns and Faron Troutt (DB 146 Page 46 & 84); thence running with Troutt in the center of the branch and leaving the branch picking up a partial fence line and running with York S. 10 deg. 23 min. W. 227.50 feet to the beginning, survey by Micheal P. Greene, Registered Land Surveyor, Tennessee number 963, address P.O. Box 412, Westmoreland, TN 37186.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed for a period of two weeks. In such situations, notices will be mailed to interested parties of record.
