NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated March 31, 2017, and the Deed of Trust of even date securing the same, recorded April 4, 2017, in Book No. 37, at Page 571, in Office of the Register of Deeds for Macon County, Tennessee, executed by Paul O Wheatley, conveying certain property therein described to Smith.Sholar.Milligan.PLLC as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for First Liberty Financial Mortgage a Division of Evansville Teachers Federal Credit Union, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by PennyMac Loan Services, LLC.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by PennyMac Loan Services, LLC, will, on September 30, 2019 on or about 1:00 PM, at the Macon County Courthouse, Lafayette, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Macon County, Tennessee, and being more particularly described as follows:
Tract 1 Beginning at an iron pin old in the south line of Walton Avenue, being the northwest corner of this tract and a corner to Charles Traughber property described in record book 7 page 615; thence with the south line of Walton Avenue south 84 degrees 31 minutes 09 seconds east 87.27 feet to an iron pin old, being a corner to BEK Properties property described in record book 26 page 148; thence leaving Walton Avenue with BEK Properties south 04 degrees 38 minutes 25 seconds west 64.76 feet to an iron pin old, being a corner to Terry Cook and Jerry Cook Property described in deed book 290 page 137; thence with Cook south 04 degrees 34 minutes 18 seconds west 78.50 feet to an iron pin old, being a corner to Philip Spears property described in deed book 281 page 234; thence with Spears and Colter north 87 degrees 04 minutes 46 seconds west 82.16 feet to an iron pin old, being a corner to Charles Traughber; thence with Traughber north 02 degrees 36 minutes 13 seconds east 147.10 feet to an iron pin old, which is the point of beginning, having an area of 0.28 acres more or less. Subject to all rights-of-ways, easements, and restrictions of record. In accordance with a survey prepared by Steven Michael Holland, Tennessee Registered Land Surveyor license number 2337, dated 03/16/2017 as shown on drawing number 170307.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes;
any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed for a period of two weeks. In such situations, notices will be mailed to interested parties of record.
