Sale at public auction will be on March 17, 2026 on or about 12:00PM local time, Macon County Administrative Building, 201 Nature Trail Way, Lafayette, TN 37083, conducted by the Co-Substitute Trustees as identified and set forth herein below, pursuant to Deed of Trust executed by AUSTIN ALLEN GRAY, to Scott R. Valby, Trustee, on July 1, 2025, at Record Book RB230, Page 663-686 as Instrument No. 25002754 in the real property records of Macon County Register’s Office, Tennessee.

The following real estate located in Macon County, Tennessee, will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:

Located in the 7th Civil District of Macon County, Tennessee, and more particularly described as follows, to-wit: TRACT NO. 4- – 12.48 ACRES: BEING located in the 7th Civil District of Macon County, Tennessee, on the Northwest side of Cotton Hollow Road, and being more particularly described as follows:-

 

BEGINNING at an iron rod in the Northwest margin of Cotton Hollow Road, same being the Northeast corner of this tract and a Southeast corner of Troy Gale Young (DB 173, PG 431, ROMCT- see boundary line agreement DB 291, PG 63-64, ROMCT); thence with said margin along a curve proceeding clockwise, having a deflection angle of 04 degrees 15 minutes 57 seconds, a radius of 1510.10 feet, a tangent length of 56.24 feet, and a chord of South 25 degrees 16 minutes 18 seconds West 112.40 feet; thence along said curve an arc length of 112.43 feet to a point, same being point of curvature of a curve proceeding counter-clockwise, having a deflection angle of 10 degrees 22 minutes 40 seconds, a radius of 1423.60 feet, a tangent length of 129.28 feet, and a chord of South 22 degrees 12 minutes 57 seconds West 257.50 feet; thence along said curve an arc length of 257.85 feet to a point, same being point of curvature of a curve proceeding clockwise, having a deflection angle of 02 degrees 27 minutes 32 seconds, a radius of 2038.50 feet, a tangent length of 43.75 feet, and a chord of South 18 degrees 15 minutes. 22 seconds West 87.47 feet; thence along said curve an arc length of 87.48 feet; thence South 19 degrees 29 minutes 08 seconds West 168.24 feet to a point, same being point of curvature of a curve proceeding clockwise, having a deflection angle of 16 degrees 18 minutes 38 seconds, a radius of 530.30 feet, a tangent length of 75.99 feet, and a chord of Smith 27 degrees 38 minutes 27 seconds West 150.45 feet; thence along said curve an arc length of 150.96 feet to an iron rod in said margin; thence leaving road with line of Tract# 5 of the Adams Estate property (11.37 acres as per survey of same date) North 54 degrees 12 minutes 14 seconds West 892.66 feet to an iron rod; thence with line of Ralph Davenport (DB 159, PG 424; DB 156, PG 32; and DB 148, PG 388, ROMCT) North 01 degree 58 minutes 37 seconds East 406.33 feet to an iron rod; thence with line of Troy Gale Young (DB 173, PG 431, ROMCT- see boundary line agreement DB 291, PG 63-64, ROMCT) South 78 degrees 03 minutes 50 seconds East 1030.98 feet to the point of beginning containing 12.48 acres more or less by survey by Carroll Carman, Registered Land Surveyor, Tennessee Number 910. address 150 Middle Fork Road, Hartsville, Tennessee 37074, dated July 29, 2008.

 

Being the same property conveyed to David Hernandez, a married man, by Quitclaim Deed dated January 20, 2022 from Yamaris Tatum, recorded January 20, 2022 in Book RB152, Page 49 in the Register`s Office.

 

Being the same property conveyed to Austin Allen Gray, a single man, by Warranty Deed, dated June 27, 2025 from David Hernandez and Brandi Hernandez, husband and wife, recorded 07/08/25 in Book RB230 I Page 661 in the Register`s Office.

The street address of the above described property is believed to be 1902 Cotton Hollow Road, Red Boiling Springs, TN 37150, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description referenced herein shall control.

THE RIGHT IS RESERVED TO ADJOURN THE DAY OF THE SALE TO ANOTHER DAY, TIME AND PLACE CERTAIN WITHOUT FURTHER PUBLICATION, UPON ANNOUNCEMENT AT THE TIME AND PLACE FOR THE SALE SET FORTH ABOVE. All right of equity of redemption, statutory and otherwise, and homestead are expressly waived in said Deed of Trust, but the undersigned will sell and convey only as Co-Substitute Trustee(s).

 

If the U.S. Department of Treasury/IRS, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor or Workforce Development are listed as Interested Parties in the advertisement, then the Notice of this foreclosure is being given to them and the Sale will be subject to the applicable governmental entities’ right to redeem the property as required by 26 U.S.C. 7425 and T.C.A. §67-1-1433.

This property is being sold with the express reservation that the sale is subject to confirmation by the lender or co-trustee(s). If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the purchase price.  The Purchaser shall have no further recourse against the Trustor, the Trustee or the Trustee’s attorney.
